Former Secret Service Agent Files RICO Lawsuit Against Clintons, Podesta and Soros

Gary Byrne, an author and former Secret Service Agent, has filed a Racketeer Influenced and Corrupt Organizations Act (RICO) suit against Bill and Hillary Clinton, George Soros, John Podesta and David Brock, among others.

A summary of the RICO suit says in part: “For the past decade in which relevant predicate acts were corruptly carried out by the named defendants as “payback” for Plaintiff Gary Byrne’s role in the Clinton impeachment and his status as a “Clinton enemy” (for his temerity in telling the truth concerning obstruction of justice and gross abuse of power), along with their corrupt surrogates and collaborators (referenced individually and collectively as the “Enterprise”), David Brock and William and Hillary Clinton have been synonymous with criminal behavior, malicious baseless attacks (using mainly the illicit and vicious defamatory tactics against perceived political enemies (like Officer Gary Byrne, the Plaintiff here) of those willing to compensate participants like Brock) – and coordinating by mail and wire to violate myriad Federal and State laws in the exploitation of Enterprise nonprofit entities they use for purely partisan purposes.

I'm of the opinion that a real investigation into this would reveal that the H1B and H2B systems are absolutely full of fraud (given my experiences job-hunting, and similar stories I've heard), to the point that it would mean the end of the tech industry, big-named companies being shut down over their fraudulent importation of aliens… and [conspiracy theory] would also show de facto population-replacement programs, tying into the forced-nonenforcement of immigration laws we've seen for the past few decades.

Well, there should be some kind of CrowdStrike way to collect money to help him. In fact, I have recently read that there has been a move to sell interests in potential legal settlements to non-lawyer investors.
I would guess that even absent the “own a share of the action” aspect there are a great many people who would send money. Especially if there is a reliable way (blogs, tweets, etc.) to get updates..
BTW - - - - - this sounds like MAGA to me

You really don’t have a clue. The specific allegations in the complaint concerning the book allege defamation, which is not one of the statutorily defined “predicate acts” that are a required element of every RICO claim. The vast majority of the allegations concern uranium, Russia, private email servers, and the crooked Clinton Foundation, for which the Plaintiff fails to allege any specific damage to his business of property as a result thereof. This complaint makes interesting reading, but from a legal standpoint, the RICO claim is going nowhere except the circular file.

Well, I do have some clue. For instance he does state a claim for the defamation.

Second, he claims that much of the harassment that he endured was in retaliation against him for testifying against the Clinton which he was compelled to do as a secret service agent in violation of 18 U.S. Code § 1513 which is a specifically prohibited act under the RICO statute.

But, it is rather a rambling complaint, and takes some 40 pages of [irrelevant and unhelpful] narrative before he gets to the first allegation of the complaint.

And I cannot find much about his attorney. His practice seems to be all over the board and this would not appear to be an area he specializes in. The firm of which he claims to be managing partner does not have website.

So, yes I have a clue, it looks like an uphill battle and of course the first step will be motions to dismiss for lack of standing [he certainly has standing on the defamation claim, which he asserts is brought under Arkansas law] and minimally states a claim for defamation. But the RICO stuff ....

So was the entire Italian community in the hey days of the Mob. But the authorities took out the King Pins and the major players who had become filthy rich from racketeering, setting off various turf wars which brought about a second harvest of racketeers under Rico.

This beast must be slayed. Let the chips fall where they.

Time to turn a RICO special prosecutor loose. Let Rudy Giuliani organize it. This is a war that must be fought, or we will lose our country to this mob of liberal fascist apparatchiks.

You could start by reading the actual statute.
Then go to www.findlaw.com and search for RICO cases. Read 3-5 of those and you can get a decent understanding of the law.

Some people seem to make a big issue of the “affecting interstate commerce”. That element was included for the sole reason of being able to claim the statute fell under federal jurisdiction. The interstate commerce require is de minimus. This means that even the remotest connection to interstate commerce is sufficient to meet that element of a RICO violation.

As an example, a court can be a RICO enterprise. Judges order supplies, computers,pens, paper, etc. That is sufficient to meet the affecting interstate commerce element.

Agree with everything you posted. Most of the commenters here don’t have a clue about RICO.

I tried to find out more about his attorney. Not much to be found; and it’s a very poorly drafted complaint.

It's terrible; worse than you know.

I was talking with some people and a Tech Writer who interviewed with a company that wanted a writing-sample, he was given an assignment to write letters of recommendation, for a H1B packet. So the company was getting free labor to fraudulently get H1Bs. Amazing. And that's how common it is, that's how bold these companies are.
