If and when McConnell carries through on this promise, Senate Democrats should immediately file a federal lawsuit against him for violating the so-called “McConnell Rule.”....

Just way too funny. The Courts, any court, imposing the Rules of the Senate on the Senate ??

There’s a judge just waiting to rule the confirmation illegal, probably the one in Hawaii.

It only delays the inevitable, just as the “travel ban” rulings did. It does not set precedent and any 4-4 decisions are simply tabled until they can be revisited with a full court.

You make a valid point but not a strong one. Even if confirmed this fall, a new justice would have no impact until this winter at the earliest.

If we have formal control of the Senate, and we can push a nominee through, we should do so up until 12 noon EST, Jan. 20, 2025.

Does anyone doubt that the Party of Satan would if they had the power?

I know of a judge who is just crazy enough and totally lawless and deranged enough to attempt to do that

A “rule” is not a “law,” Skippy.

Here’s the Rule according to this Leftist.

SCOTUS Justices can only Die or Retire in Odd numbered Years.

The Biden Rule was clear, no SCOTUS Seat filled in the Eighth and final Year a President is in Office.

That “rule” only applies when the opposition party holds the Senate.

Nice try, but four of the current justices were appointed before mid-term elections. It is not the same as having a president who is leaving office appointing a life-term justice.

Even the rules of the senate are not law.

“When rbg goes its gonna get real”

I can’t wait to see that show! But let’s hope we hold the Senate, otherwise her replacement will be very difficult.

The minority party needs to have some remedy, some legal recourse, when the majority leader is completely immune to considerations of fairness and consistency in his exercise of the Senate’s substantial constitutional powers.

Their hypocrisy knows no bounds. The minority party has a "remedy", they can vote for or against the nominee, but that doesn't mean they get veto power, which is what they want.

How do you bring a LAWsuit against a perceived violation of a RULE?

The Senate Rules are not law, so I don’t know how you can bring a LAWsuit against it?
