They had to go all the way down to Louisiana State University School of Law in order to find someone to make an argument this idiotic. I’m sure they could find a sympathetic federal judge in Hawaii though, who could be persuaded to issue a nationwide injunction . . .

Clearly, the validity of this rule change would be a constitutional question, rather than a political question, because it implicates a fundamental democratic principle: majority rule.

In their tiny mind, perhaps.

McConnell made it clear that he was referring to Presidential elections in a March 20, 2016, interview with Chris Wallace on Fox News Sunday. He said:

“So, all we’re doing, Chris, is following a long standing tradition of not filling vacancies on the Supreme Court in the middle of a presidential election year.”

These are exactly the type of cases that the higher courts hate to take and avoid if possible. It’s political calculus that has a remedy through legislation. The Senate is given the ability on how it conducts business and that means the Senate Majority leader schedules what the agenda is.

It's not law; it's in Article I of the Constitution that each chamber makes its own rules. There is nothing a court can do about it.

I can’t decide if you are being sarcastic or serious - with your PM and this. I was merely curious WHICH of the names by googling was the guy who wrote the article. Why was that so difficult?
