hmmm Unlike some other wimps on the GOP, Rand is hard to convince. The dude just got physically assaulted before so he can make up his own mind.
I hate the Kavanaugh pick...
I believe three Democrats from red states supported Gorsuch, so if we get those again (and that is very possible here), we would have 53 even with Rand Paul being an ass. Not sure about whether McCain is able to vote (or is even alive at this point), so in that case we would have 52. Even if Collins and Murkowski were to defect, we would have 50 and Pence would provide the tiebreaker.
I think he’ll be confirmed, but it will take awhile as Kavanaugh has quite a paper trail.

I think they will figure out the McCain issue before the vote.

If Ann’s ok with him I’m ok with him. Trust me if anybody can sniff out a liberal rat it’s her. And she’s still well connected in those circles I’m sure so if there were serious concerns about Kavanaugh believe me she’d be voicing them.
He’s getting through and the court will be solidified.

Wrong. I lower court judge CAN disagree with a precedent. There is no supreme court lock on a lower court judge’s mind, legal thinking or decisions. A lower court judge CAN make a legal argument contrary to a precedent. In fact, a lower court doing so is the begining of how a precedent can be over turned. Now then, the supremes may reject that lower court’s argument and stick with a previous precedent, sending the case back to the lower court with a ruling against them. BUT THEY ALSO, the supremes, ARE NOT BOUND BT THAT PRECEDENT EITHER. Why? A precdent is not the Constitution of the United States and it and only it, not any “precedent” is the supreme law of the land. No court ruling or precedent is above a legal argument that it is wrong, none.

My response to you was entirely on point: he was not populist at all. If you think so, just read a lot of the responses here of people who thought he smacked of Harvard and Yale, Washington DC and the Bushes.

There are some indications that Sotomayor has some health issues. Whether they are serious enough to impact her ability to be on the court is unclear at this time.
