Alan Dershowitz Explains Why President Trump Chose Kavanaugh Over Barrett

Less than a day after President Trump announced Judge Brett Kavanaugh as his choice to fill the vacancy left by Justice Anthony Kennedy on the Supreme Court, Todd Starnes spoke with Alan Dershowitz, Harvard Law Professor and author of The Case Against Impeaching Trump, about why Judge Amy Coney Barrett was not selected.

"I don't think the President decided not to pick Barrett, I think he decided to not to pick her for this vacancy. I think he anticipates several vacancies. If Ruth Bader Ginsberg leaves, he might pick her then. The American people have to know one thing that distinguishes these two. I think that, very likely, Kavanaugh will cut back on Roe Vs. Wade. I think he thinks it was wrongly decided, that it should be left to the states. Barrett may have a very different view. She believes that there is a right to life that the fetus is an innocent citizen of this country. And basically, maybe she believes, that states don't even have a right to permit abortion. Most Americans won't support that," Dershowitz said....

Oh please. Dershowitz is a liberal but he is an honest liberal. Just because we don’t agree with something doesn’t mean we shouldn’t listen to him. He has a brilliant legal mind

Hogwash.

Barret may personally believe that all abortions are murder but I doubt that she believes that abortion could be made totally illegal by federal judicial writ.

For a couple of reasons I think Dershowitz is wrong on her and Roe.

1 Read the part in her Wiki bio on her views of Roe.

She clerked for Scalia for a time. Scalia was like her a devout Catholic. For all his disagreement with Roe, he did not think the Constitution alternatively had any mandate to ban abortion. As a Constitutionalist, like Barret, his view of Roe came from his view of the Constitution, in which he saw it silent and mute on aborion with no Constitutional mandate for or against it. Roe was wrong he said because their was no mandate for any Surpreme court decision mandating it be legal or mandating it be banned. I think Barret agreed with that and Dershowitz does not know what he’s talking about when it comes to Barrett’s thinking on Roe.

I think Dershowitz, and many others are making excuses, because growing Conservative analysis of Kavaenaughs federal case history is suggesting a “moderate” Trojan horse wrapped up (by the GOP establishment) as a “staunch Conservative” as “gift” to Trump.

Democrats have an excellent idea to pack the court. The next time a Supreme Court appointment comes up, and there's 3-4 people to choose from, CHOOSE ALL OF THEM!!

Let President Trump say he was inspired by the Democrats and gives them credit for appointing Thomas Hardiman, Amy Coney Barrett, Amul Thapar, AND Ann Coulter.

Hey, you have to have one crazy choice, just to make the Dems blow a gasket and implode....heh heh heh, Amul Thapar.

He may well be right. Makes sense, and shows strategic thinking by Trump.

Here’s what I appreciate about Dershowitz- he has reasons for his ideas and is able to articulate them. He does not resemble the left of today in any way. He’s essentially homeless.

The new left emotes, reacts and distracts. Instead of reasoning and talking about ideas, they resort to the personal in brilliant use of Alinsky tactics.

Dershowitz tells you what he believes and why. I think most of his beliefs are incorrect, but I respect his old-school ways.

I used to have liberal friends like Dershowitz. We would debate and argue and have interesting conversations. I loved them, they loved me. Now? It’s a measure of how greatly we’ve changed as a country that none of us speak to one another. It began after 9-11.

I agree with ‘not been a judge long enough’ but in addition Barrett was a very important add for the 7th Circuit and until we have a better situation in the Senate she should stay there. I do think this November that there will be a significant pick up in Senate seats. I think the dems have really started to show their socialist true colors and #walkaway etc. are having an effect.

I would advise people to stop listening to Dershowitz.


I don’t take his pearls of wisdom seriously ever since I read Virginia’s testimony how he had intercourse with her 5+ times in different states and locations when she was an underaged teen.

There is no testimony I’ve read or name on manifest that I’ve seen that places him on Pedo Island. However, he had sex many times with Epstein’s favorite sex slave, starting when she was 16.

I just don’t feel comfortable taking sage constitutional advice from a married guy who acts like he’s the greatest thing in the world but will whip down his cashmere suit pants to {verb} an underaged kid. Call me judgmental.

I would be willing to bet most Americans don’t know if Roe v Wade is struck down, it simply sends the issue back to the individual states to decide. The rhetoric makes it sounds like overturning it would outlaw abortions and that is not true.

It’s sad, isn’t it? I had a best friend. I love her just as much as ever. She fought for gun control. Probably still does. Environmentalist. We used to be able to discuss carefully our differences. We still agreed on art and children and entertainment and relationship stuff.

Then along came the election, and mid 2016 she simply dropped me as a friend. We haven’t spoken since. My heart is still broken. I’d take her back in a second. I knew her politics and loved her anyway. Apparently she could no longer tolerate mine. And she knows damn well I’m no homophobe or racist. She’s known me since we were kids, known my multi ethnic etc group of friends. Yet Trump was too much for her to stay friends with me.

And you would be right. Just had that discussion today with a pro-abortion person. Abortion would be legal in most states, and even where it wouldn’t be, there will still be abortions. It’s like murder or rape. Laws don’t get rid of them. It’s easier to murder the unborn than the guy Joe sleeping with your wife. Joe will be missed. No one has to know you were ever pregnant, and many doctors will out of principle still perform D&C’s on a living embryo in their patient’s womb. There will always be abortions, just like murder.
