(Florida) ‘Stand your ground’ law protects shooter in deadly fight over parking space: sheriff

An argument over a handicapped parking spot at a convenience store in Florida led to a fatal shooting and the man who pulled the trigger won’t be arrested under the state’s “stand your ground” self-defense law, authorities said.

Pinellas County Sheriff Bob Gualtieri told reporters during a Friday press conference that Thursday’s shooting death of Markeis McGlockton, a 28-year-old father of three, is “within the bookends of stand your ground and within the bookends of force being justified,” the Tampa Bay Times reports.

“I’m not saying I agree with it, but I don’t make that call,” Gualtieri told reporters, adding that his agency will now forward the case to the State Attorney’s Office for a final decision.

He could have refrained from doing so and been dead seconds later. No way I would have hesitated.

The guy who hit him was retreating.

When the victim hit the ground the perp was continuing to take a step forward...Only when he saw the victim reach for his weapon did the perp start backing up...

No doubt the guy was seriously rattled when he got knocked off his feet by the gorilla and we don't know what conversation was taking place...

My advice is: don't park in a handicap space if you don't have a sticker...

Was white guy simply do-gooder incensed that black girl took a space wrongly? Or was he handicapped and privileged for that space? Absolutely no word on this.

The guy's posture wasn't all that normal looking...I'd bet he got robbed of the handicap space...

I concur, not a good shoot. Man was out of line shoving shooter to the ground, shooter was no longer in danger when he killed the idiot who shoved him.

So if McGlockton had come out and instead of pushing Drejka had pulled out a gun and shot him, would he also get off under “stand your ground”? After all he could say he was defending his girlfriend from an aggressive individual.

Naw, McGlockton, would be arrested and imprisoned for being a Felon in possession of a firearm, and for murder in the course of a Felony, and the use of a firearm in that murder. The girlfriend might even be charged as an accessory.

McGlockton might even get the Needle.

Maybe, but my point was that full or not, parking in a handicapped space is still a violation.

Watch the video again and pause @ :20s. Look at the frame at 20s. How many people are within 7 yards of the guy on the ground and what are their dispositions?

There are 3, maybe 3.5 seconds, that pass before the shot. Your brain may be wired to react calmly within 3 seconds of a blind sided attack but it's not realistic to expect that of everyone that is attacked. Also, kudos to you for being so even keeled.

What if he believed he was still in danger?

If I was him, I would have believed that I was in danger what just having been assaulted for no reason by some goon who is still standing over me.

Do you know what happens to white people when they are on the ground in front of several black people?

You ever seen what comes next?

Says the guy is ho wasn’t just pushed to the ground and not there knowing what may come next. You lay there and wait for the cops. They’ll be there in 20 min or so....

If you were that strong of a supporter of the 2A, you’d realize there’s not enough info there for you to make that call. You weren’t on the ground knowing what had been said.

I would need to know what the shooter told the cops as to why he shot. Was he disoriented from hitting the ground?

The eyewitness had the good sense to skedaddle when he saw the gun but the thug and his girlfriend stayed right there...In fact, when the girlfriend saw the boyfriend approaching, she got out of the car...So there then was a double threat...

It almost appears that before the victim shot, he quickly trained his weapon on the female as if she might be a threat before he aimed at the big guy and fired...

And since the eyewitness saw and probably heard everything from start to finish, could be his testimony led the police to claim the guy innocent...

Although it's possible that the dead guy was making threatening statements after the push his body language in the few seconds before he was shot seem to be him saying "OK,I'm done".

Seems to be. May not be though. A guy lying on the ground after being physically assaulted may see it differently. Let’s give him a break. No one needs to touch anyone else in the midst of an argument...once you do, all bets are off.

Then why did they refer the case to the State’s Attorney?

Political pressure as a consequence of the racism angle.

If it was an obvious case for prosecution, the shooter would have been arrested on the spot. He still might be arrested if there is enough pressure applied in the right quarters. But it won't go well for the State if that happens.

I would bet that the DA does not want to touch this case.

At this point fear and getting an accurate shot off is likely about all the shooter's mind can really process,...

That about sums it up, and that is imminent fear of death or great bodily harm, lethal force self defense criteria.
