The state of New Mexico failed to provide at-risk students a proficient public education and has until next year to address shortcomings, a state district court ruled in a yearslong case filed by civil rights groups.
Plaintiffs alleged that the state didnt adequately fund public schools nor provide programs and services needed to ensure students are college, career and civic ready, particularly students who are low-income, Native American, English-language learners and those with disabilities.
Attorneys for plaintiffs in the consolidated case filed by the Mexican American Legal Defense and Educational Fund and the New Mexico Center on Law and Poverty also contended that students lacked access to social and health services, including tutors, that could help mitigate the impact of poverty on learning.
This decision is so monumental, said MALDEF staff attorney Ernest Herrera in a conference call Monday. It recognizes that students have rights that go beyond just minimal compliance, that things such as multicultural education, bilingual education, training of teachers in bilingual education, these things are not simply window dressing, these things are requirements.
The state plans to appeal the ruling. New Mexico Education Secretary Christopher Ruszkowski said in a statement that unfortunately, the judge missed the boat with this ruling. He added that education spending in New Mexico is now at an all-time high and that the state is seeing significant student achievement gains.
Judge Sarah Singleton gave the state until April, 15, 2019, to take steps to ensure New Mexico schools have the resources necessary to give at-risk students the opportunity to obtain a sufficient education, including making reforms to the current system of financing public education to help address shortcomings.
Ms. Singleton, in her July 20 ruling, addressed what she called a contention by defendants that there is no more money available.

You can GIVE knowledge, but there is no guarantee that someone will TAKE that knowledge.
Many moons ago I had a couple of engineers from Nicaragua. They had gone to school in one room schools with multiple grades. They spoke and wrote better English than any of my other engineers. They were great engineers. How much you get from your education has little to do with classrooms or class size. It has much more to do with the student and the student’s desire to learn. Both these guy said their parents were desperate for them to get a good education and immigrate to America. Both were supporting extended families.
It’d be interesting to see the familial set up of these at risk kids. It’s hard to believe that with June and Ward at home the state would still be failing the Beave.

Indeed. It’s similar to the rulings that police have no enforceable obligation to protect any individual citizen or solve any particular crime.
School systems cry, “Just spend more money!” but there is, overall, a negative correlation between higher school spending and results.
School is not a right but a privilege. No one should be forced to impart their knowledge to an ungrateful brat.

If the kids dont want to study and the parents dont care about learning, then what can the schools do?! Send the kids to janitor class. Teach them how to take out the garbage.

Yes, and the budget part is already done. A long time ago I read on FR about a judge (in Arizona iirc) getting involved in school budget. It is crazy how much power the judges are allowed to have.

There is an unlimited amount of money that can be spent on “education” without impacting the actual accomplishments of students in any demographic category. Have a look at your own school district’s budget, and remember the employee pension liabilities are probably around 100% of the current operating budget.
What percentage of the “at risk” children were born out of wedlock and are being raised by welfare moms? Did the judge address that?
