Sort of. First the DA has to decide whether they think a crime was committed and that they can pursue criminal charges. If they decide they should, then at trial the defendants can use, as their defense, that it was an accident, if they so choose.

So, if the Jury decides for the defendant in such a situation, they are finding not-guilty, but clearly implying that they too believe it was an accident.

That was the core perspective that resulted in my initial post.

Are you being sarcastic. I was doing more than clarifying what I was talking about in my very first post. Sheesh. Is it something in the water today. I was just enjoying myself, discussing simple subjects on which most reasonable people agree on a foundational level.

Usually if I want this sort of argument I go to the liberal sites. I can mention there that the sky is blue and they will argue not only that it is turquoise but precisely what shade of turquoise it is and then point out in no uncertain terms that my lack of understanding of the official science behind the assignment of names to colors proves I’m a knuckle dragging Trump supporter. :-D

But none of this is important enough to get emotional about. ;)
