Same as in most states you can’t harvest deer meat or antlers from a road kill.
I agree, however, this is another - if you don’t like the law change it.
I don’t imagine many people have contacted elected officials about it and my guess is native American tribes would fight any changes.
I believe but would have to check that this law applies to all raptors, not just bald eagles.
Was the law written when bald eagles were endangered?
Maybe that’s the reason. They are not endangered anymore.
Agreed! There are quite bigger fish to fry and the keeping of a feather as a crime is not one of them
And how is the District Attorney going to be able to prove that the eagle died naturally, or that the feather just "fell off" when the eagle swooped down?
Since it is neigh impossible to falsify (i.e., disprove) such a "tall tale" (me and my buddy were just sitting there, in our canoe, minding our own business, when suddenly this eagle came swooping down, and moments later this lone eagle feather wafted down on the wind into our canoe..." - or "Honest, Mr. Forest Ranger, sir, we bought this authentic Indian headress from a tribesman who swore that the eagle had died a natural death..."), the law is written in the strictest possible fashion.

The law is just a bone that was thrown to the Native Americans. The irony is that it has stayed on the books for 80 years unlike treaties that were broken at will.
That was what people were doing and then claiming they "found" the feathers or bones.
Which is why the law was written that way.
Since the eagles are no longer endangered the law probably should be done away with.
