In a letter to CPV, DEC Regional Director Kelly Turturro wrote that the company was required to submit a complete application and obtain a federal Clean Air Act permit prior to operation of the facility. She wrote that CPV has not submitted an application for a permit nor has a permit been issues as required.

Other side of the coin my foot! Cuomo ok'ed this then lefty nutjobs applied pressure. This is a political game.

Recently, FERC overruled the state, which refused to approve the gas line, contending insufficient information was provided. A judge has issued a temporary stay on the construction.

At Saturday’s rally, Malick urged Governor Andrew Cuomo to “following in his father’s footsteps” and permanently keep CPV from opening its power plant. When Mario Cuomo was governor, he refused to allow the Shoreham nuclear power plant to open because of large scale local opposition.

DEC denies permits for Millennium pipeline to power CPV plant

ALBANY – The State Department of Environmental Conservation has conditionally denied water quality permits for Millennium’s proposed 7.8-mile Valley Lateral pipeline project.

That 16-inch pipeline is meant to power the CPV electric generating plant under construction in the Town of Wawayanda.

The DEC said the conditional denial “is based in part on the inadequacy of the environmental review conducted by the Federal Energy Regulatory Commission (FERC), which failed to account for downstream greenhouse gas emissions.”

WAWAYANDA – Six people were arrested by State Police for disorderly conduct Friday morning when they blocked the construction entrance site to the Competitive Power Ventures in Wawayanda on Friday morning.

When completed, the facility will generate electricity through the use of natural gas from Pennsylvania.

The protestors were arrested for blocking the entrance to the site by way of interconnected bike locks around their necks. Margaret Shaw, Pramilla Mullock and actor James Cromwell were among those taken into police custody, along with several others who did not participate in the "chaining up" demonstration.
