A former Minneapolis police officer who shot and killed an Australian woman last summer is seeking to have a civil case filed against himself and others stayed until after his trial on third-degree murder and second-degree manslaughter charges has concluded.
Mohamed Noor filed a request for a stay Thursday in U.S. District Court.
The family of Justine Damond - the woman killed in the July 2017 shooting - filed a lawsuit in federal court last month against Noor, partner Matthew Harrity, former police chief Janee Harteau, current police chief Medaria Arradondo and the city.
In the lawsuit, Damond's father, John Ruszczyk, claims the defendants violated the Fourth and 14th Amendments. The lawsuit seeks damages in excess of $50 million. Noor's request for a stay, though, states he should not be made to defend a civil matter while at the same time facing criminal charges.
On Wednesday, defense attorneys said the charges should be dismissed, arguing in motions that the charges should be dropped because of prosecutorial misconduct and lack of probable cause.
A hearing on the motions is scheduled for Sept. 27.
