I wouldn’t assume that no one was carrying. Chances are at least one person was. I tend to believe they simply didn’t want to involve themselves as their was no personal risk of death or grave bodily injury.
That’s the legal standard here in IL.
If your weapon leaves the holster you damned well better be able to articulate a serious threat to yourself and that there was no other choice. Otherwise the Cook County Prosecutor will make your life a living hell.
Downstate and in the burbs it would probably be different.
