The story went viral and they wound up with way more money than they ever expected to see. They thought they could manage it for him. What little they did give him, he quickly squandered on drugs.
This couple may have a little dysfunction in their lives as well. She did run out of gas on the interstate. Not exactly a sign of strong financial health. And he likes to gamble.
So on one end you have this couple, overwhelmed with money and suddenly not really excited to part with it and on the other end, you have a drug addict who blows every last dime he has getting high. And in the middle, you have the GoFundMe phenomenon which, as pointed out above, doesn't really have a whole lot of oversight as to how funds are distributed.
You may be right. From a legal standpoint, I’m not sure they defrauded HIM.

Isn't that redundant? Are there true pretenses? Is a phony pretense the truth?

Sounds like typical liberals who would like to control his life with other people’s money. They raised the money for him, they should just give him the money. What he does with the money is his business. But they should have known that he would blow it.

Yup. But I have nothing against lawyers. They have a service and people simply hire them to get the job done. It is what it is.
Not only that, the dude who managed the GoFme fund blew some of it at the casino LOL. One already knew what kind of clusterF this would be when a junkie is involved.
This should be real easy to figure out. They raised $400,000. Do an accounting of how much money they have in the bank and, to the extent they paid any expenses out of it, what they paid. The homeless guy probably is wrong but I wouldn’t put it past someone to do what he said — use an incident like this for personal gain. It has happened time after time before.
If you set up one of those accounts for me and then denied me the funds you’d have “The Texas Hammer” or some other lawyer on your doorstep. LOL
Very, very wishful thinking on your part, I am afraid. This never will "go to court". It's just a shakedown. It is just enough money to attract lawyers like flies on manure. But it is not enough money to make it worth their while to "go to court".
The lawyer on the drug addict’s side is certainly working on a pro bono basis meaning he will keep 40% to 90% of whatever is left right off the top plus his “expenses”. The young couple will either find a lawyer who will take his cut out of the remaining funds or depending on what is left, they will just roll over and give the remaining money to the dead beat’s lawyer. In either case there will be not be enough funds left to be an incentive for anyone to take this to court.
The one thing that you can be absolutely sure of at this point, is that after the lawyers take their cut, the dead beat loser will get a tiny fraction, if anything at all, of what is currently left and will squander every penny on drugs and booze.
I hope the starry eyed young couple did spend most of the money trying to help Johnny and reimburse themselves for his multiple burglaries of their home. It will be that much less for the blood sucking lawyers to divvy up.
I’ve often wondered who controls the funds raised in those GoFundMe drives and how it is ensured that the funds go for the purpose stated during the fund raising campaign. Still wondering.
And we do not know that. Many of the folks standing/sitting at intersections are CON artists. I see Homeless/Vet signs. I ask where is your VA ID? Answer, I left it on my dresser.

If that's true, the balance of the 'go fund me' money should be managed by some third party charity.
There are also charges that the couple spent A LOT of the money on themselves.
That needs to be resolved also.
Never said that. Sounds like a real BS story from the start. Both parties are most likely con artists. Most likely the druggies knew the man from begging themselves.
That’s true. Their last $20 would be to buy more drugs.
