So its all over but the voting. Im writing this column on the assumption that Judge Brett Kavanaugh will soon be Justice Kavanaugh, despite the Democrats continuing efforts to convert a futile battle over ideology into an ugly one over transparency and ethics. By the first Monday in October or soon thereafter, the Roberts court version 5.0 (accounting for the earlier arrival of Justices Samuel Alito, Sonia Sotomayor, Elena Kagan and Neil Gorsuch since Chief Justice John Roberts took his seat in September 2005) will be underway. What then? Most answers to the What then? question have offered side-by-side comparisons of Brett Kavanaugh and the justice he will be succeeding, Anthony Kennedy. What part of Justice Kennedys 30-year legacy will he embrace? What part will he repudiate? Id like to shift the field of vision and consider the impact of Judge Kavanaughs arrival on the eight other justices on the dynamic of the Supreme Court as a whole. Justice Byron White, who saw 13 new justices take their seats during his own 31-year tenure, once remarked that every time a new justice joins the court, its a different court.

We probably need one or two more seats to really cement a conservative majority. Then the battle will shift to bureaucracy versus the courts.
I suspect the leftists have made a federal government loving moderate into a person deeply distrustful of the left.

I think that you are right. This latest stunt with some anonymous letter that Senator Feinstein has had since July is a joke. Of course, the Loonie Lefties will like this but the rest of the 75% of Americans will find this beyond the pale.
I am awaiting the inevitable departure of Breyer and/or Buzzi. Trump’s appointment of their successors will surely turn the nation back to the Constitution.

My point is the left are so out of control that having ‘our’ guys on the Supreme Court is no guarantee.
No matter which way an Election goes, the very idea that we even have to worry that a Judge or a Politician can just ignore our precious Constitution and institute any Policy they want without suffering any consequences is repugnant.
If we don’t win elections, we are done for. We aren’t there yet, despite clear evidence of widespread voter fraud.
I guess the way most of US felt when Sotomayor and Kagan were confirmed is unimportant. Because it is ALWAYS about how wacko Libs feel, isnt it? How did we feel when Kagan was confirmed, knowing what her family upbringing was? We knew Sotomayor wasnt that bright, but Kagan was actually scary. And we knew, when she didnt recuse herself from the Obamacare decision after arguing FOR IT as Solicitor General, that she should never have been on the Court. But we bit the bullet as Obama was in the WH and could pick the most radical Judges he wanted and we knew the GOPe would vote for them because elections have consequences. I have no sympathy for any of these drama queens now.
The Left figured out how to fool Americans and get what they wanted. They rightly believed that the Supreme Court would enable them to run the country while the government had a façade of Constitutional government answerable to the people. Americans finally figured out what was happening and the Left is in trouble. It may be too late, but at least we have a chance to turn it around.
That is a legitimate fear, hope it doesn't become true but you can never really know their heart until after they put on that black robe .
