Fox News reporting FBI investigating Ramirez and Swetnick claims

NeverTrumper Neil Cavuto reporting the FBI has reached out to the idiots Swetnick and Ramirez. If this is the case Wray ignored Trump’s directions for a limited supplemental background investigation. This is 100% BS. These are not credible accusations and neither is Ford’s. This is a witch hunt.

Statement from President @realDonaldTrump: “I’ve ordered the FBI to conduct a supplemental investigation to update Judge Kavanaugh’s file. As the Senate has requested, this update must be limited in scope and completed in less than one week.”

Your first sentence is 100% B.S.

Sweatpit actually filed a sworn statement, so it would be premature to call her allegation "not credible."

Ramirez's attorneys had already been in contact with the Senate Judiciary Committee attorneys several days ago, so following up with her is merely a formality.

My advice to anyone with an IQ over 70 is to turn Fox News off and find somewhere else to get your information.

I don’t doubt you recorded it. But apparently you don’t understand it. The proposal made by Flake was for those three women. And that is what the Senate leadership agreed to. And that is what they forwarded to President Trump.

It doesn’t matter what Trump wants. He also ordered the “immediate” release of the unredacted FISA docs but the DOJ pushed back and disregarded his order.

Trump has no control over these people. They have made themselves an unaccountable four branch of government.

Even when the FBI comes back with the results of their investigation that indicate too many discrepancies and no way to sustain the allegations, the fascists will still want Kavanaugh’s head.

They will also accuse the FBI of not doing a legitimate investigation because Wray is afraid Trump will fire him.

There Are No ‘Credible Allegations’ Against Kavanaugh

Leftists are trying to kick the Senate confirmation for a Supreme Court nominee down field and past the November elections. They have shown they will do so at any cost. While compelling emotionally, Ms. Ford has no witnesses and no facts to back up her story.

There was no legitimate reason the allegations were not summarily evaluated, and a Judiciary Committee vote taken this week.

I was honored to be able to attend yesterday’s Kavanaugh hearing – a hearing that should never have taken place. It was intense, dramatic, emotional, and outrageous, but nothing changed. The allegations are not sufficient to derail Judge Kavanaugh’s nomination.

Leftist law breaking, rule breaking, violence, and disruption have already marred the public Kavanaugh confirmation hearings. The Senate has allowed this circus to continue, and in the process has delayed a timely confirmation vote on Judge Kavanaugh.

The vote to confirm can’t come soon enough. That the Senate hasn’t voted yet is shameful.

The Senate Judiciary Committee issued a statement that it will request that the administration instruct the FBI to conduct a supplemental FBI background investigation with respect to the nomination of Judge Brett Kavanaugh to be an Associate Justice on the Supreme Court.

The Senate request was for the FBI to investigation “credible allegations.” There are no “credible allegations.”

Nevertheless, President Trump authorized the supplemental investigation as requested.

If fairly conducted, this “supplemental investigation” could have been over yesterday. The Committee requested that the FBI investigation take no more than a week. This will not satisfy Leftists trying to destroy Kavanaugh.

It is urgent you let your Senators know how you feel about the Kavanaugh confirmation process. You can reach your Senators at 202-224-3121.

After witnessing the spectacle in person yesterday, the Senate owes Judge Kavanaugh an apology. And perhaps the best apology would be a vote finally to confirm him.

Will we really know anything more a week from now?

I think people misunderstand these FBI investigation procedures.

Maybe I misunderstand, but my understanding is that the FBI interviews people, compile reports, and deliver reports to the Judiciary Committee.

And then we will be back to he said/she said, because the FBI doesn’t draw any conclusions about the validity of what people say.

All this may do, is placate soft Republicans such as Murkowski and Collins, that everything was done that could be done to investigate allegations.

18 U.S.C. § 371—Conspiracy to Defraud the United States

The operative language is the so-called “defraud clause,” that prohibits conspiracies to defraud the United States. This clause creates a separate offense from the “offense clause” in Section 371. Both offenses require the traditional elements of Section 371 conspiracy, including an illegal agreement, criminal intent, and proof of an overt act.

Although this language is very broad, cases rely heavily on the definition of “defraud” provided by the Supreme Court in two early cases, Hass v. Henkel, 216 U.S. 462 (1910), and Hammerschmidt v. United States, 265 U.S. 182 (1924). In Hass the Court stated:

The statute is broad enough in its terms to include any conspiracy for the purpose of impairing, obstructing or defeating the lawful function of any department of government . . . (A)ny conspiracy which is calculated to obstruct or impair its efficiency and destroy the value of its operation and reports as fair, impartial and reasonably accurate, would be to defraud the United States by depriving it of its lawful right and duty of promulgating or diffusing the information so officially acquired in the way and at the time required by law or departmental regulation.

Hass, 216 U.S. at 479-480. In Hammerschmidt, Chief Justice Taft, defined “defraud” as follows:

To conspire to defraud the United States means primarily to cheat the Government out of property or money, but it also means to interfere with or obstruct one of its lawful governmental functions by deceit, craft or trickery, or at least by means that are dishonest. It is not necessary that the Government shall be subjected to property or pecuniary loss by the fraud, but only that its legitimate official action and purpose shall be defeated by misrepresentation, chicane or the overreaching of those charged with carrying out the governmental intention.

Hammerschmidt, 265 U.S. at 188.

The general purpose of this part of the statute is to protect governmental functions from frustration and distortion through deceptive practices. Section 371 reaches “any conspiracy for the purpose of impairing, obstructing or defeating the lawful function of any department of Government.” Tanner v. United States, 483 U.S. 107, 128 (1987); see Dennis v. United States, 384 U.S. 855 (1966). The “defraud part of section 371 criminalizes any willful impairment of a legitimate function of government, whether or not the improper acts or objective are criminal under another statute.” United States v. Tuohey, 867 F.2d 534, 537 (9th Cir. 1989).

The word “defraud” in Section 371 not only reaches financial or property loss through use of a scheme or artifice to defraud but also is designed and intended to protect the integrity of the United States and its agencies, programs and policies. United States v. Burgin, 621 F.2d 1352, 1356 (5th Cir.), cert. denied, 449 U.S. 1015 (1980); see United States v. Herron, 825 F.2d 50, 57-58 (5th Cir.); United States v. Winkle, 587 F.2d 705, 708 (5th Cir. 1979), cert. denied, 444 U.S. 827 (1979). Thus, proof that the United States has been defrauded under this statute does not require any showing of monetary or proprietary loss. United States v. Conover, 772 F.2d 765 (11th Cir. 1985), aff’d, sub. nom. Tanner v. United States, 483 U.S. 107 (1987); United States v. Del Toro, 513 F.2d 656 (2d Cir.), cert. denied, 423 U.S. 826 (1975); United States v. Jacobs, 475 F.2d 270 (2d Cir.), cert. denied, 414 U.S. 821 (1973).

A lot of people are missing a huge point here.

From a political perspective, would the Republicans have been better off confirming Kavanaugh (A) two weeks ago, or (B) next week?

The answer is (B) -- and in a big way.

Putting Kavanaugh in front of that Judiciary Committee on Thursday was a brilliant political move.

I've been saying for two weeks now that the longer this drags on, the better it is for the Republicans.

The Democrats have spent three months painting Kavanaugh as an evil bastard. As a result of the events of the last two weeks, they've now managed to do the impossible: They've turned him into a VICTIM.

I actually think the FBI investigation will be a net plus for Judge Kavanaugh in the end. They’re not going to find anything. They’ll only bolster Kavanaugh’s testimony. And when Democrats resume all their bluster about “impeaching Kavanaugh!” Republicans can say, “For what?” and use the additional FBI investigation they so demanded against them.

I believe thwy said the scope was existing allegations. That would include those two nuts as well.

Those two are goong nowhere. Otherwise dems would have made it a 3 ring circus with those two women testifying as well.
