Question:

Isn’t it just a “Motion to proceed to consideration” that begins the debate?

Cloture vote is only needed to stop a filibuster in the event the opposition actually chooses to filibuster correct?

If there is no real filibuster they can ask unanimous consent to proceed to a voice vote?

If they KNOW they have the 60 votes needed to invoke cloture and have the votes needed to confirm I can see the majority giving the minority a chance to “save face” and confirm the nomination by voice vote. Thoughts?

I know that Mitch filed for cloture, but I never saw anything about the actual vote. Seems like it would have been news around here.

Do they need 60 votes for cloture? I thought that was the Reid nuclear option, which changed it to 50?

Any thoughts of what that may look like?

I can honestly see the potential for riota unlike we have ever seen before. The number of “screamers” that made it into the hearing room to do their thing during his testimony are an indicator of the size and scope of the commitment to create a scene. Etc.

I think 60 is still needed to invoke cloture. I think the nuclear option is used if the cloture vote fails and they just force the vote and IF they get 50/50 then VP gets to vote. Is that correct?

Filing for cloture is required before the Majority Leader can call for a roll call vote which is required to INVOKE cloture. I believe that you only need 51 Senators to sign a letter requesting the cloture vote on the floor. But you need 60 votes to adopt the motion

The definition of a filibuster is that you have 51 votes needed to start a floor debate under regular order. The motion to invoke cloture requires 60 votes to pass. Failure to get 60 votes doesn’t end the filibuster nor does mean the nomination is NOT confirmed. Failure to get 60 votes on a cloture motion only means the filibuster may continue. I say make the opposition actually filibuster. See who is willing to do it.

The “nuke” option is only needed if the opposition actually does a REAL filibuster
