The 64-year-old was agreeing with sentiments earlier expressed by Kagan suggesting that the exit of Kennedy could mean the reputation of the Supreme Court suffers.

'It's been an extremely important thing for the court that in the last 40 years, starting with Justice [Sandra Day] O'Connor and continuing with Justice Kennedy, there has been a person who found the center, where people couldn't predict in that sort of way

'That's enabled the court to look so it was not all by one side or another and it was indeed impartial and neutral and fair. And it's not so clear that I think going forward that sort of middle position — it's not so clear whether we'll have it.'

I think a review of Kagan’s (nominally) suthored opinions (Both minority and majority) have declined since she was appointed.

I suspect Roberts has found her work ethic to be lacking....

I think a review of the quantity over time of Kagan’s (nominally) authored opinions (Both minority and majority) have declined since she was appointed.

I suspect Roberts has found her work ethic to be lacking....

Given her no vote, I think she did the right thing by pairing. If enough votes. let him be at his daughter’s wedding. I think BK would agree and understand.

An other obvious attempt at Misdirection! There is nothing immoderate(!) about the Conservative position, which is merely to interpret the Constitution as intended!

The activist position, which seeks to justify a form of judicial legislation is something clearly wrong--something clearly reprehensible. You do not compromise with usurpation. You stop it, for all & exactly the reasons you have a Constitution to begin with. [ Constitutional Overview ]

One person in the middle is very powerful. They can accept bribes from either side. Two in the middle makes it a little harder to know who to make a deal with. Be not decidved they are for sale one way or the other.
