Supreme Court allows North Dakota to enforce voter ID laws

The Supreme Court on Tuesday refused to toss out an appeals court order that allows North Dakota to enforce its voter ID requirement during the 2018 elections.

The request to toss out the order came from a group of Native American residents who are challenging a new state law that requires voters to present identification that includes a current residential street address.

The challengers argued the new rule disenfranchises a disproportionate share of the population because many Native American voters live on reservations with no street addresses.

The District Court agreed and temporarily blocked the state secretary from enforcing the new requirements during the primary elections, but the Eighth Circuit Court of Appeals blocked that court order last month.

The challengers asked the Supreme Court in an urgent request submitted to the Justice Neil Gorsuch to toss out the Eighth Circuit stay, arguing it has left thousands of Native American voters unable to cast ballots, but the court denied the request without explanation.

The Court's newest member, Brett Kavanaugh, did not take part in the decision.

Justice Ruth Bader Ginsburg, however, filed a dissenting opinion, which Justice Elena Kagan joined.

Ginsburg said she would have granted the challenger’s request. She said last-minute court orders affecting elections, especially conflicting orders, can result in voter confusion and keep people from turning out to the polls.

“The risk of voter confusion appears severe here because the injunction against requiring residential-address identification was in force during the primary election and because the Secretary of State’s website announced for months the ID requirements as they existed under that injunction,” Ginsburg said.

“Reasonable voters may well assume that the IDs allowing them to vote in the primary election would remain valid in the general election.”

His name was Michael Moretti, but I don’t remember him from the TV series.

There must be some way people on the reservation identify where their people live, like maybe “the brown house on the north side of Eagle Hill”. How do other states with reservations do it? It can’t be that hard. Fortunately, I believe most Native Americans live outside of the reservation.

My understanding is that tribal residents can still provide other documents to vote.

The Democrats were trying to pull a fast one and get the exception for a PO Box to be applied statewide.

It’s way past time for Indians to get addresses. This is the 21st century. C’mon.

This article references North Dakota voting laws, not So.Dakota.

This ruling in the 8th District is the law of the land in Arkansas, Iowa, Minnesota, Missouri, Nebraska, North and South Dakota. Time to roll out in other districts and have SCOTUS rule on it nationally. Voter ID. Strange requirements to vote in America.

The second to last show Vick’s dad showed up and told Walt that he named his son Vick also. I thought it was a neat trivia question but didn’t remember Michael. I guess she must have had two brothers.

"A nation without borders and without strict, yet reasonable voter "checks" soon ceases to be a nation."

Particularly if that nation has 65-70 million criminal illegal aliens.

. . . unless it was Michael in the books. I haven’t read them yet but they are next up on the schedule. I’m just now finishing up the Jack Reacher series by Lee Child.

A bit misleading story. It was an emergency appeal. It was in Gorsuch’s circuit and the story makes it sound like he turned it down by himself. But the fact the two court members dissented, means he must have referred it to full court in conference, meaning it was 6-2 to deny request.

Oops. My bad. So, I looked up NORTH Dakota voter id laws. Same thing -— Tribal or BIA ID can be used. If no address is listed, an additional form of ID is needed to back that up. I would assume mail addressed to that person will suffice.

Many on those reservations (wonders) are more nutty than the protestors banging on SCOTS’ doors.

“Well, seems to me the Reservation Council needs to start naming their streets and assigning addresses. “

Ahh, no, that’s not necessary. With the 911 emergency system came street addresses for all. What used to be rural route 5 or some other odd address now has a genuine street number address with a city name as a part of it. I live in rural ND just a few miles from a rez. They all have street numbers for the 911 system to work.

This lawsuit was just plain BS.

When the drool comes out of the right side, it means she’s agreeing. On the left side, she’s dissenting.
