Kavanaugh backs Trump on jailing and deporting immigrants for crimes committed years earlier

Newly seated Justice Brett Kavanaugh spoke up Wednesday in defense of the Trump administration’s view that legal immigrants with criminal records can be arrested and held for deportation, even years after they were convicted and completed their sentences.

At issue is a federal law that calls for mandatory detention and possible deportation for “criminal aliens,” including legal immigrants convicted of crimes ranging from violent felonies to simple drug possession. The law says the Homeland Security secretary “shall take into custody any alien” with a criminal record that could lead to deportation “when the alien is released.”

The debate focuses on when exactly is “when”?

In a class-action suit brought in California, lawyers for the American Civil Liberties Union complained the mandatory detention policy has been applied to lawful immigrants who had lived and worked in the community for decades after being convicted of misdemeanors, such as drug possession charges.

The administration argues that a provision of the 1996 law calls for arresting and jailing such immigrants, despite their good records after serving their time....

There are exceptions for petty offenses ...could include shoplifting, simple assault, or a DUI that did not involve driving without a license or damage to property or persons, depending on the law ‘in your state’.

Leave it to the LA Times to once again misinform. Illegals are now called immigrants. We went from illegal aliens to illegal immigrants to undocumented immigrants to undocumented migrants then undocumented workers and the left just said “to hell with it” and now just flat out calls them “immigrants”.

It won’t take long for the ACLU and other America-hating groups to figure out that their BEST POLICY, in a world of bad options, is to simply NOT fight laws they don’t like, and instead hope they can get rid of Republicans, so as to have Dems who will simply ignore those laws.

To put it another way, they need to be very careful about driving the courts to set precedents, as they won’t be very happy as to what those precedents are.

Oh the supreme court has ruled on the case? - no the haven’t - its commonly know questions asked in hearing don’t necessarily reflect how a justice will rule. This is all very premature. Lets see some ruling first before we get all excited. Everybody so impatient these days.

The last time I visited Japan, one of the questions on the immigration form asked "Have you ever been convicted of a crime?" and adds the clarification "(Not just in Japan?)"

Lie and they will find your sorry @$$ and kick you out of the country on the next available flight.

A Canadian acquaintence says their detention facilities are actually pretty nice. His flight home was cancelled on the same day his tourist visa expired. No alternative flights were available until the next day. They told him he had two choices:

(1)He could go get a hotel, come back the next day and probably be allowed to leave without paying the normal fine or put on the list to forbidden re-entry.
(2)He could volunteer for overnight detention, come back the next day and guaranteed to be allowed to leave without paying the normal fine or put on the list to forbidden re-entry.

Of course, he chose option (2) and noted the overnight accomodations were not bad at all and neither were the meals provided. The point being that the Japanese take their immigration laws very, very seriously but are also not without compassion.

If that’s the law, Kavanaugh is sworn to uphold it, unless it’s unconstitutional. I can’t see how it’s unconstitutional, because legal aliens simply do not have the same rights as citizens.

If the liberals don’t like that law, they can write their congressmen.

There are a lot of legal aliens who come here with green cards for work. Apparently, this law says that if they commit certain crimes, they can be deported, even if they’ve served their time. Legal aliens may be legal, but they don’t have full citizenship rights.

I’m guessing these legal immigrants are not citizens. They are simply here legally.
