Why is this suit accepted, instead of being thrown out when they tried to file it?

If they are attempting to gain asylum, then by UN regulation, they had to apply for such in their home country -OR- in the first country they arrive in, which is Nicaragua.

If they are making the asinine statement that they have US Constitutional rights, then why not everyone else in the world? If then, that everyone in the world has US Constitutional rights, then what is the point of US citizenship?

We really need to get out of the UN.

Because our judicial system is building reasons to mass-deport thousands if a single class with a simple decision in a single case?

This would be a start...let’s see where this goes.

The caravaneers already have received asylum from Mexico. Those continuing on are not in danger of persecution by Mexico’s government (which is a requirement of asylum), so they have no claim for asylum in the US.

Not only do they lack standing as they have no rights to violate, they also lack jurisdiction. A 1st year law student should be able to get this case dismissed by one simple motion.

Don't you have to have standing to bring a lawsuit?

How does a citizen of a DIFFERENT country have standing to bring forth a lawsuit regarding constitutional rights in a country they are not a citizen of?

Am I missing something here? Not a laywer but have been to civil court a couple of times for contract disputes, which only qualifies me to know a little more then nothing at all.

What’s the basis of the suit? Trump said they would process every request. It seems they people suing have no standing; they haven’t been denied process, they haven’t even entered the country yet (thus don’t have the 5th Amendment protections yet), and they haven’t filed for asylum. They could have saved themselves 1000s of miles by applying for asylum at any Embassy or Consulate they passed along the trek north.

I think they have to have a motion to dismiss and bring evidence that it has no merit. Otherwise the judge who threw it out will be overturned. And if I am right that seems fair. Judges shouldn’t rule on a case before hearing from both sides. That said there are reasons to dismiss it right now, but by the time they get to filing the motions the caravan will have arrived and some of those arguments I mentioned in my post above would be mute. If the evidence shows that we are processing all asylum requests in the usual manner, then the suit should be dismissed.

This should be dismissed and sanctions assessed against the lawyers who filed it. Absolutely zero good faith basis under facts or law.

Moving a problem to the US doesn’t solve the problem, it spreads the problem.

To let vicious Central American criminals run loose among people already granted asylum here in the USA would be absurd.
