Thorney issue about censoring “content”. White HOuse lawyers must emphasis the assaultive and brash “behavior”. Can’t let the Judge go off on Acosta was banned because of what he said. Must be on disruptive behavior and not his rudeness or accusative questions.

Can’t say he broke rules (e.g. one question, one follow up) because these rules are not written down and have not been agreed to by the WH correspondents association which seems to run part of the show

I agree. If any judge rules that Acosta and/or CNN have “rights”, the precedent will be set for all of us to demand our rights to be anywhere, any time we want. If we decide to be rude to police officers, we can use this as a precedent, that they are “not the boss of us”... etc.

We can only hope that the judge will consider these possible future problems.

What would happen if Acosta as a journalist showed up at a city council or county commissioner meeting anywhere that was open to the public, asked questions, but would not sit down and shut up when told to do so as the council or board wanted to move on to the next questioner? He would be removed by security, that’s what, and might be banned from attending such meetings for a period of time. Why does he think he has a right to disrupt or hijack White House proceedings?

Judges have the easiest schedules, they probably work 3-5 hours a day. I’ve been on juries that lasted 2 weeks that should have lasted 2 days. Constant breaks and canceled days...yeah, I know they have lots to do in closed chambers, but this is an example of a no brainer case. The President can’t decide who is allowed into his press conference? Ridiculous. I have as much “right” to be there as Jim Acosta, i.e. none. It is a privilege, not a right.

In all seriousness what concerns me is that a pro-CNN court ruling that stands will create an “official” media.

IMO, that's what this really all about. They've been pushing a "reporter's privilege" for ages. See Branzburg v Hayes.

Trump should just not hold scgdduled press conferences or briefings.


I posted yesterday that Trump should announce that the press conferences and briefings will now mirror those held by Obama. I understand that he and his people had extremely few of them. Just say, “I’ll do what Obama did.” How can they argue with that?

Is the WH “legally obligated” to hold press conferences? I don’t believe it is. Just quit having em and put out written press releases along with using social media to get the word out. Just bypass the whole damn bunch of em for awhile and let em police their own.

If they rule that way Alex Jones should demand one. That should tie our entire Federal court system in knots for the next thirteen years.

He has just as much right to one as CNN.

While I agree with you that it doesn’t make sense, that is one of CNN’s legal arguments, as I understand it.

Their suit is on First and Fifth Amendment grounds. Part of the Fifth is a requirement for due process in before deprivation of property by the government.
