Supreme Court reins in the feds' land grab for endangered species

The federal government can’t designate land as a habitat for an endangered species on the mere prospect that the species might eventually move there, the Supreme Court ruled Tuesday, delivering a victory to property owners.

In a unanimous ruling the justices rejected the federal government’s attempt to designate roughly 1,500 acres in Louisiana as critical space for the dusky gopher frog.

You know you are wrong when it is a 9-0 decision. How did the lower courts get it wrong?

My thoughts exactly, more legislating from the bench in the lower courts.

“In a unanimous ruling the justices rejected the federal government’s attempt to designate roughly 1,500 acres in Louisiana as critical space for the dusky gopher frog.”

It continues to incense me that the Trump Administration, almost half-way through it’s first term, has not succeeded in weeding out the Obola holdovers. It is an embarassment that they have not stopped this stuff from continuing. Either he’s the President over every department, or he’s going to be a failure in the eyes of the voters in 2020.

” But the government, fearing future events might push the frog back, sought to designate the land, which would have imposed severe restrictions on what the owners could do with it.”

What I want to know is who, with great specificity, are the government officials responsible for this nonsense. It’s not o.k. to just call it “the government” and let the bad actors get away with continuing to pull this crap.

An unanimous opinion. Even RBG wasn’t buying the Government’s cock and bull story.

“We can bet the farm that environuts were behind this.”

For sure! And we know that wingnuts like the Sierra Club and Friends of the Earth are always there blowing their horns. But there still have to be government employees promulgating and carrying out these orders, and I think we need to have their name out in the public domain.

Actually, this administration was the other party in the matter and upholding the appellate court's decision.

But....see my next post.

Had to be deliberate. Obama’s attempt to eliminate private property.

As you know, many federal employees are virtually untouchable. And there are tens of thousands of them in a myriad of agencies all over the country. So take a deep breath and relax, Trump has bigger fish to fry than the insignificant hacks writing reports that have no weight and produce nothing but transient noise.

The biologist designate what they believe is the habit that provides the best breeding, feeding, and rearing of offspring over a broad range of land. Then they drive down the road and when they spot that and development occurring they swoop in to stop it.
