Memo: FBI recommended Michael Flynn not have lawyer present during interview, did not warn of false

Former FBI Deputy Director Andrew McCabe, who arranged the bureau's interview with then-national security adviser Michael Flynn at the White House on Jan. 24, 2017 — the interview that ultimately led to Flynn's guilty plea on one count of making false statements — suggested Flynn not have a lawyer present at the session, according to newly-filed court documents. In addition, FBI officials, along with the two agents who interviewed Flynn, decided specifically not to warn him that there would be penalties for making false statements because the agents wanted to ensure that Flynn was "relaxed" during the session.

The new information, drawn from McCabe's account of events plus the FBI agents' writeup of the interview — the so-called 302 report — is contained in a sentencing memo filed Tuesday by Flynn's defense team.

Malicious prosecution for political purposes. After the sentencing Flynn needs to file a civil lawsuit against Comey, McCabe, Mueller like what Corsi recently did.

This means any american citizen should explain to the FBI agents that they do not wish to speak to them about anything without a lawyer present, and then answer any question with the lawyer present with the statement “ on advice of council, I cannot answer that question”. It will make it hard for the FBI to conduct investigations, but they have brought it on themselves. Maybe abolish the FBI instead of abolish ICE. Hand their duties back to the US Marshall Service. It’s been a political operation since it’s inception under Hoover.

It doesn't matter. You don't refuse to talk to the FBI when you are in a position like that.

That would be like the CFO of a major corporation refusing to talk to the company's chief counsel. The refusal to speak is -- in and of itself -- pretty damning evidence that you have something to hide. More importantly, it means you are incapable of doing your job because of some legal problem.

How is this not entrapment. Case should have been thrown out from the beginning. I would think that Flynn would have a due process case against the FBI.

Absolutely.

I can understand the Rats supporting this.
It promotes their agenda and protects them.

But the depth and breadth of the swamp is demonstrated by establishment entrenched GOP luminaries like Grassley, McConnell, Sasse and Graham protecting this cheap punk. If the GOP establishment was not protecting Mueller, he would be gone.

Either they all dipped their beaks in Hillary”s Uranium money OR the y otally, utterly corrupt CIA and FBI are black mailing them or BOTH.

Mike Flynn is not naive.

His interview with Kislyiak(sp) had been unmasked by NSA, leaked to WaPo, prior to this meeting on WH orders. Read the letters in his attorneys’ pre-sentence brief to Judge Sullivan. Flynn is in the 99% of Intel agents in the US.

He knew McCabe because he wrote a letter in support of FBI Agent Robyn Gritz who stood up to McCabe’s dirty cop mob at FBI and got harassed til she resigned..

Flynn stood up to Obama on his pro-radical Islam policies and was summarily dismissed because of it. He's a truth teller. Again, read the 30-40 letters written about him referenced above.

I still don't grasp what he admitted guilt to doing in that interview with Strozk and Joe Plenta(sp). I do know he would not have lied for no reason. That is not what Intel agents with brain power and years of experience dealing with evil McCabes of the world do.

I await the rest of the story when General Flynn is once again free to speak. The attorney gave a hint when noting the Aug date of the 302. In a text message sent by Strozk after that interview, he states, "Launch 302". And that indicates that the plot to get Flynn fired was locked and loaded. Obama's warning to Trump not to hire Flynn didn't work. Sally Yates warning to Trump not to trust Flynn didn't work. So the 302 was launched probably with lies in it. It must have been rewritten in August. Why? Flynn has chosen to make this known. He's a deliberate man. Time will tell.

Because they led Flynn to believe it was no big deal and he never imagined they were trying to trap him in a crime. Charging him was an injustice.

The lie was that he hadn’t discussed the sanctions. They were trying to make discussing easing the sanctions a crime. The whole premise is outrageous.

Thanks for your input. I worked in NY State Corrections, and any report regarding an interview/incident, etc. had to be completed before we left work...even if we had to stay after on overtime to complete it. Unusual Incidents such as riots, or severe injuries to staff or inmates had to be reported to Albany immediately with final report to follow within an hour or so. That’s why I was surprised to see that so much time had elapsed. It smelled to high heavens. I had no idea that the FBI doesn’t record any interviews. How has that practice been allowed to remain in place in this day and age? One FBI agent says something, and the other swears to it, whether it’s a lie or not. All the more reason to have a lawyer with you. And just because McCabe has a law degree, it doesn’t put him in the position of giving legal advice to anyone. I hope they nail his a$$ to a tree on what he, and the others did to General Flynn. Total set-up from the beginning.

A mild correction, but key: it ain’t a “criminal justice system”; that’d be the zenith of hubris. What we’ve got is a “criminal LEGAL system” and that’s all it is.

Ya won’t get a life-saving draught of fresh water outta that Dead Sea & y’ought not talk as if ya might.
