BOSTON (AP) — Boston Marathon bomber Dzhokhar Tsarnaev’s convictions or death sentence should be tossed because it was impossible for him to get a fair trial in the same city where the shrapnel-packed, pressure cooker bombs exploded, his lawyers told a federal appeals court on Thursday.
In a 500-page brief filed in the 1st U.S. District Court of Appeals, Tsarnaev’s legal team outlined a host of other problems with his 2015 trial, during which the defense admitted from the outset that he and his older brother carried out the attack. His appellate lawyers are also pointing to issues with jurors, certain testimony from surviving victims and the defense’s inability to tell jurors about links between Tsarnaev’s brother and an unsolved triple killing in 2011.

His lawyers argue the trial court judge’s “first fundamental error” was denying the defense’s repeated requests to move the case out of a city that was “traumatized by the bombings, ordered to shelter in place during the manhunt, saturated by prejudicial publicity and united in the Boston Strong movement.”
“This case should not have been tried in Boston,” the attorneys wrote.

It wasn’t declared but it happened anyway. House to house searches, citizens barred from leaving their homes, innocent non-suspect civilians forced from homes at gunpoint... it’s all well-documented.

Mueller is famous for keeping four men he knew were innocent in jail for life, in order to protect Whitey Bulger. Putting Tsarnev to death to protect the real bomber is a perfect fit for his MO.
So Comey vs. Mueller doesn’t really make a material difference does it.
Anyway, Comey is up to his eyeballs in this as well.
There is no question about his guilt. There is even video evidence of his planting the bombs. There should be a public hanging of this POS on Boston Common with his miserable corpse fed to hogs

You must have been watching a different channel and reading different news sources than I was.
Nor would I. That said, I always get a laugh when a Hollywood production shows someone shooting someone and killing them. The laugh comes when 99.9999% of the time, the person who pulled the trigger...turns away and pukes. WTH is that? Hollywood writers/directors/producers projecting their own sense of morality onto the characters? I can't figure it.

It was a federal trial. Charges were brought by the US AG.
Agreed. I’ve seen people die, more than one, some violently. I know what my reaction is to death. Something like that POS? I’d finish him and go get a sandwich, or maybe raise a glass to those who suffered because of him. But sick? No, pure satisfaction.
Note that the Democrat Death Penalty Opponents will NEVER get near people like this.
Instead they rely on their Leftist judges to undercut, if not effectively eliminate, the Death Penalty, and they rely on ‘principled conservatives’ to sit out elections because the Republican on the ticket isn’t 100% as pure as Reagan (thereby allowing Democrats to place those judges on the bench).
Grateful to know I’m not the only person who didn’t swallow the Mueller-Comey-MSM Kool Aid on this case.

Our sap-happy US government cannot assure the public that it is now enforcing immigration laws already on the books,
(1) that foreign nationals must at least avoid criminal activity,
(2) that foreigners must stay off public assistance,
(3) that the US govt is disinclined to grant "asylum" (means a free ride on the US gravy train and endless SS payments) to “fearful refugees” from war-torn Islamic regions,
(4) on-the-book govt mandates that force struggling taxpayers to foot the bill for the refugees to go back and forth between America and their supposedly hostile homelands on the taxpayers' dime.

THERE'S MORE---Bostonians were enraged upon discovering THEY footed the travel bills of the entire Chechneyan family to attend the trail of the surviving bomber brother.
As they planned the bombing, the family received "every conceivable public benefit available out there" amounting to some 100 thousand dollars.
The evil Tsarnaevs worked the system bigtime; the entire family pocketed, including:
(1) the two bombing suspects' parents (mother later absconded--wanted for shoplifting),
(2) the two suspects themselves,
(3) their trouble-making sisters (one arrested for bomb threats),
(4) the widow of the suspect killed, and,
(5) their child.
Could also include benefits for their Chechen "student" pals who tampered w/ bombing evidence (one is now in jail, the other going to trial).
