My questions are:
1) Why does the judge think it was arbitrary?
2) What are the proper procedures that the judge thinks should be followed?
Well, he can't let the cat of the bag, now can he? The Commerce Sec. will have to just guess the procedure and expect more judicial hits as he still doesn't get it "right."
