I'm Suing the Government. It Has a Problem With That.

A federal appeals court recently heard oral arguments in my lawsuit against former Attorney General Eric Holder, unnamed “John Doe” federal agents at the FBI and Justice Department, and others. At issue are the intrusions into my computers while I worked as an investigative reporter for CBS News, revealed by multiple forensic investigations showing use of proprietary government surveillance programs.

It was clear early on that the Justice Department was not interested in investigating or prosecuting its own. So I began the search to find the facts about the invasion into my computers and life. That morphed into a lawsuit for damages, because that’s what the law sets out as the legal remedy.

What’s been most striking to me in this process is just how one-sided the rules are when Americans take on their own government. Although I had experienced some of this, albeit in the context of reporting consumer safety and taxpayer advocacy stories over the years, it has been dismaying to learn the extent to which rules and laws shield the government from accountability for its abuses -- or even lawbreaking. That includes special rules delaying matters, such as requirements to give a 180-day notice to even bring the lawsuit; special pleading rules that permitted the government to go years without ever having to produce documents or answer questions under oath; special rules developed to shield high-ranking officials like the attorney general from accountability regardless of how egregious the conduct might be; and special rules allowing the government to simply not produce information to its own citizens – even about the citizen bringing suit -- without any real consequence or objective explanation.

It’s been a long and frightening lesson.

Another chilling report of the extent of corruption that exists in the Federal Government, especially within the Justice Department. The Dogs of War have been unleashed and they are out to run down and destroy any American citizen who displeases them.

The House of Representatives voted Thursday to hold Attorney General Eric Holder in contempt for refusing to turn over documents tied to the botched Fast and Furious gun-running sting -- a discredited operation that has become a sharp point of contention between Democrats and Republicans in Washington.

The House approved a pair of criminal and civil measures against the attorney general, marking the first time in American history that the head of the Justice Department has been held in contempt by Congress.

Almost none of the are ever held to account. The entire cabal that tried to steal the election and destroy Trump's presidency are getting off Scot free.

They use the bureaucracy for YEARS until everybody loses interest and it fades into the woodwork. Who’s got the tenacity and resources to go after these bastards for a decade or longer?

Yep - an institution that feels the need to protect/defend itself has a lot more resources and patience when it comes to making sure the upstarts don’t hinder it....lots of folks in government wish they could pull a Stalin/Castro/Maduro/Little Kim/Pol Pot on the People....and they made unconstitutional “laws” to help them.

Like Europe of old, the self selecting aristocracy arrogantly protects itself as it turns the populace into peons.

The law should be biased towards the citizen, not the government. A Republic founded by the populace, not a “King by Divine Right”, demands no less.

The DoJ has shown their complete hostility to the elements of the American Revolution and should be subjected to a complete makeover making it the servant of the People and not their master.

We can start by repealing the Westfall Act and abolishing the concept of Sovereign Immunity for the government. In a nation where the People are sovereign, it’s absurd to extend such immunity to the very group who are supposed to serve the sovereign. If that makes working in the government difficult and even risky, so be it. We didn’t ask for a government of self-appointed Inquisitors.

Whenever I read of Sharyl Attkisson’s case, it is a matter of “There But For The Grace Of God Go All Of Us.”

She was a reporter.
A member of a protected class — a status which you and I could never claim.

She has fame.

And wealth.

And supporters.

And a large, devoted internet readership.

And all the leisure time in the world to pursue this.

And the media spotlight upon her.

You and I have NONE of these.

If she can’t obtain justice . . . after many years . . .

What chance would you and I have?

She has been thrown out of the pool. She has told the truth and has gone after too many sacred cows. These are unforgivable sins, so they are no longer protecting her.

If my case fails to move forward, with all of its detailed allegations and forensic evidence, it would effectively mean that no surveillance claim can ever be made to stick against the government. It would essentially create immunity for the feds who hack citizens’ computers because the government, which holds the evidence, can obstruct and refuse to produce it. That seems entirely inconsistent with the rule of law.

This is another illustration why it is so hard for Trump to drain the swamp.

The doj, fbi and court system has had decades to promote laws and regulations that cover their collective asses.

Does any one really believe that the FISA judges didn't know that the fbi was lying?

How about this f'en stiff, Wray, that is the head of the current fbi?

Other than getting his bowels in an uproar over the 30 day gubbmint shut down what in the hell has he done to clean out the filthy, corrupt shit hole known as the fbi?

And I am sick of hearing about how 'upset' the regular boyscout fbi agents are over the corruption. They are all a part of it because they know someone that is corrupt and are sitting on their ass hoping that some other agent will 'do the right thing', because they are covering their pension status.

Ball-less cowards.

Since the Libs don't believe in due process, why don't we lock up the top 20 most egregious liberal offenders of lying to congress, conflict of interest, or abuse of office? (hard to pick)
