Don't forget that in NY State, they not only tax what you make (your income), but they also levy a sales tax on what you spend out of the residual (your outgo); as well as a recurring tax on what you own there, resident or not (property tax).

The Yankees don't just hold their spring training in Florida. They have a year-round training facility there, and players from the big-league team routinely go there for rehab assignments when they are on the disabled list.

I'm convinced they do this so the players can be considered "working in Florida" for those rehab assignments, instead of in New York. That's why the team always issues a press release in the New York media to make an announcement every time a player is assigned to the Florida training facility.

That is why the Yankees spring training is in Florida - a state with no income tax.

I think they have spring training in Florida because the weather is good. The no tax is a bonus.

They’re not being taxed for leaving, they’re being forced to pay the taxes they owe for periods while they were/are there. The tax collectors are just paying closer attention to those who claim to have left the state.

In every state where I've worked, the law is very clear: income taxes are paid based on where an employee works, not where he lives or where the employer is headquartered.

I once worked in a branch office outside New York for a company that was based in New York. There was no way in hell I'd ever pay New York taxes in that situation.

That's a good question. I'm sure each of those states has something written into their laws describing what happens in a situation like that.

The place where a person is registered to vote and/or serves on juries would be an obvious indicator of where he or she lives. Also ... which location is used when filing Federal taxes?

I fled nearly 35 years ago and that remains one of the best decision of my life. I was a young adult when John Lindsey fundamentally transformed NYC from the Big Apple to a welfare magnet. That said I wouldn’t trade my memories of growing up in Brooklyn for the world!

Even when you are right, the courts have ruled in favor of the tax pirates. For instance, individuals who worked in the Phila Navy Yard, exclusive jurisdiction US Federal Property, and who lived in NJ, used to travel by ferry from NJ to the navy yard. IOW, they never set foot in filthadelphia. The city said they owed city income tax. They went to court. They lost at the SC eventually.

IMO, the government today has become the equal of George III, they don’t listen, don’t care to listen, and could care not a whit about what the peasants think. The government looks at any income as belonging to it and they deign to let you keep a portion just to keep you placated.

Louisiana is about as bad,,, wanted to charge me in excess of $2000 because I had the audacity to cancel my auto insurance when I moved out of state.
Oh,, BTW they made this charge 14 YEARS after I had moved, and sent a lien to the Treasury Department!

I heard that on the radio. It’s was astonishing. He sees the problem right in front of him but can’t figure out it’s him. It’s absolutely amazing.

My son tells a story about saving money. Wages are like water being being poured into a cup. Expenses are like holes in the bottom of the cup. If the water flows in fast that out, the result is savings. Back to Cuomo, he is drilling more and more holes in the bottom of the cup and wondering why the cup isn’t filling faster. In addition, he is slowing the water flow into the cup.

If NY allowed fracking, stopped being a nanny state, stopped being oppressive to business in general and allowed liberty in, they would thrive. That’s pretty much the opposite of Cuomo and every other democrat in the country.

One would logically get a D/L, voter’s card and file Income Taxes in the most advantageous location. [giving up any homesteaders real estate tax benefits in the other two locations].

Given in the scenario there is no employment income to tax, would either of the other two States be likely to argue with the official residence choice?

Odd how what was obvious that “spring training” was held in a temperate climate has morphed into a tax avoidance scheme.

A sad commentary on the state of New York and their tax structure. Just ask General Electric, Kodak, and Xerox.

I can understand this. You play 9 games in NYS, the state taxes you on whatever percentage those 9 games make of what your yearly salary is—even if you are sitting on the bench. But what if you’re on the disabled list and stay at home, i.e. you never are physically in the state? Do they still tax you?

The problem is proving you don’t owe $1. They request many records, information about relatives in NY and it can cost thousands of dollars in professional fees to prove you don’t owe $1. They are also loath to close out to audit.

I’m sure they would like to tax you and probably attempt to do so unless YOU can prove you weren’t in-State that day.

I assume the State taxing authorities are like the IRS where they assume you are guilty and you have to prove that you are not.
