Court rules AR-15 gun maker can be sued over Sandy Hook shooting

HARTFORD, Conn. — Gun maker Remington can be sued over how it marketed the Bushmaster rifle used to kill 20 children and six educators at Sandy Hook Elementary School in 2012, a divided Connecticut Supreme Court ruled Thursday. Justices issued a 4-3 decision that reinstated a wrongful death lawsuit and overturned a lower court ruling that the lawsuit was prohibited by a 2005 federal law that shields gun manufacturers from liability in most cases when their products are used in crimes. The plaintiffs include a survivor and relatives of nine people killed in the massacre. They argue the AR-15-style rifle used by shooter Adam Lanza is too dangerous for the public and Remington glorified the weapon in marketing it to young people. Remington has denied wrongdoing and previously insisted it can't be sued under the federal law. The majority of the high court agreed with most of the lower court's ruling and dismissed most of the lawsuit's allegations, but allowed a wrongful marketing claim to proceed. "The regulation of advertising that threatens the public's health, safety, and morals has long been considered a core exercise of the states' police powers," Justice Richard Palmer wrote for the majority.

The deranged punk didn’t go out and buy this weapon. So how is Remington “guilty” of marketing this weapon to young people?

Lanza killed his mother after stealing HER weapon.

I hope Remington appeals to a higher court.

Will breweries, wineries and distilleries now be sued for drunk driving crashes?

Really a silly bit of grandstanding by the Conn. SC. They obviously know that SCOTUS has no option but to throw out this ridiculous decision.

The Protection of Lawful Commerce in Arms Act (PLCAA)explicitly protects firearms manufacturers and dealers from being held liable when crimes have been committed with their products.

A state court even a state SC cannot overrule federal law at their whimsy PERIOD!

Likely nothing if they so desire. Top shelf attorneys would be happy to do this one pro-bono just for the publicity as it’s quite obviously a slam dunk.

How do you successfully prosecute a manufacturer for marketing a legal weapon?

It's a civil action not a criminal one. The families filed a negligence lawsuit.

The shooter did not buy the gun himself. His mother bought the gun for her own use. The shooter stole it from his mother.

So how does the way this gun was advertised matter? The person who bought it did not commit the crime.

Gee, Your Honor, even a cursory reading of the Protection of Lawful Commerce in Arms Act would show that Remington did nothing wrong and is fully protected under the statute. Where did you get your law degree, in a box of Cracker Jack? Or were you one of those law students that had your Daddy bribe the admissions office?

This should never even have gone to trial, but now that it is there will be a summary motion to dismiss that is going to be hard to deny.
