Dick's Sporting Goods Settles Lawsuit Over Gun Sale Age Restrictions

Tyler Watson, a 20-year-old Oregonian, settled his age discrimination lawsuit last month against Dick’s Sporting Goods. In February, the retailer changed its firearms policy, raising the minimum age to buy a gun to 21.

Soon after the change, Watson attempted to by a .22 caliber Ruger rifle and was turned away.

The legal age to buy a gun in Oregon is 18, but Dick’s made the decision to raise the minimum age after the store learned a 19-year-old school shooter in Parkland, Florida, had legally bought a firearm from one of its stores. The corporation encouraged the government to similarly raise the federal age for purchase.

Lawyers for both Watson and Dick’s declined to comment, saying the settlement details are confidential.

Jim Oleske, a professor at Lewis and Clark Law School specializing in anti-discrimination law, said people settle for a variety of reasons, but he thinks Watson had a good case against Dick’s.

“From the text of the statute, it looked like a very strong case,” said Oleske.

Oleske said it’s unusual that Dick’s hasn’t changed its policy as a result of the settlement.

“Any other individual could go into any one of their stores, attempt to make a purchase and if they’re turned away bring a lawsuit,” he said. “The question is, why is Dick’s settling?”

Earlier this week, Forbes reported that Dick’s is considering removing all hunting gear from its stores, and has already done so in 10 pilot stores.

Walmart also raised the minimum age to buy a firearm and Watson has a similar lawsuit pending against them.

I’ve proffered that if a 16 y/o is old enough to vote, they’re old enough to be put in harm’s way on the battlefield.

As ardent a supporter of the 2nd Amendment as am I, what business is it of the courts what a company sets as its sales policies? Think wedding cakes. If Dick’s wants to commit corporate suicide by taking firearms out of Sporting, let them. The Free Market will solve any such issues. Dick’s will never see a penny of my hard-earned money.

And if they want to settle a case, that is their right. We don’t know the terms but we do know from history that companies weigh the cost of litigation against the proposed settlement. No conclusions can be drawn from this.

Speaking of which, the Stormy Daniels / Creepy Porn Lawyer settlement by DJT is a good example of a relatively paltry sum to make an annoyance go away. What was it, 115k or so? Chump change. How fast can a lawyer rack up a fee like that /rhetorical. Didn’t SeeBS pay 5M for their hush money? That’s the range of payoff where you know there’s there there.

And Shakespeare was right (NOT a call to action, just an observation).

Today’s (Friday?*) walk out protest is started by a 16 year old in Sweden.
She says to Parliament, “I want you to panic. I want you to feel the fear I feel every day!”
Such irrational, illogical thought should eliminate them from casting something as powerful as a ballot.
Do you think illegal immigrants wouldn’t vote themselves largess (property) a la South Africa? They are conditioned to believe that white Europeans have stolen their ‘cheese’!

Drop out of school and be cannon fodder. I was in the 82d Abn Div Infantry and left high school at the ripe age of 17. I support putting HS dropouts of both sexes into Corps of Engineers work brigades or similar work, but not the Peace Corps.

It’s not the court’s business in many cases, like what hours to keep or what merchandise to carry. For better or worse, there are discrimination laws and a retailer can’t choose who to sell to based on an age threshold that contradicts the law. When someone does that it becomes the court’s business.

Good Point. Last time I stepped foot inside Dick's I bought a Mossberg Model 80 they had on sale for $199, minutes before they ran out of stock. This was before they made this dumbass marketing blunder capitulating to the gun grabbers. Now, I refuse to patronize them. Let the market decide their fate.
