To Get Trump’s Tax Returns, N.Y. Democrats Try a New Strategy (abuse of power)

ALBANY — In an attempt to work around the White House, Democratic lawmakers in Albany are trying to do what their federal counterparts have so far failed to accomplish: to obtain President Trump’s tax returns.

Albany lawmakers are seeking state tax returns, not the federal ones at the heart of the current standoff in Washington. But a tax return from New York — the president’s home state, and the headquarters of his business empire — could likely contain much of the same financial information as a federal return.

Under a bill that is scheduled to be introduced this week, the commissioner of the New York Department of Taxation and Finance would be permitted to release any state tax return requested by leaders of three congressional committees for any “specific and legitimate legislative purpose.”

The bill is the most recent proposal from New York lawmakers trying to cast light on the president’s personal finances and business dealings, but it could also open the Democratic majorities in the Legislature to charges of politicizing state law to embarrass the president ahead of his expected re-election campaign.

Trump's lawyers need to be ready to file their lawsuit against this 10 seconds after Cuomo signs it. And they should seek punitive damages for gross abuse of power.

Americans are protected from bills of attainder at both Federal and State levels because the Founders were fed up with these sorts of evil games. It’s one of the reasons Americans tore themselves away from England. A just court would smack it down.

I assume each of us has filed a tax return. Ever remember attaching a bank statement, copy of your balance sheet, or snapshot of your IRA/401K/Retirement savings account?

All the “financial information” they will get will only be used for harrassment, it will tell them nothing.

So far, no committee has been able to articulate a specific and legitimate legislative purpose, because there isn´t one. They are trying to conduct a criminal investigation through House committees.

Where do you find one? What with FISA secret courts, Red Flag secret courts, judges making law and plain old corruption, I’d say there is a better chance of catching a unicorn than there is finding a just court.

More especially I think it could be argued that this is a bill of attainder, also constitutionally prohibited. It will take years for that to get to the SC.

Can't file suit until an actual request has been made. Until then, Trump has no standing in court.
