Trump officials to challenge authority of judges to issue national injunctions

Vice President Pence on Wednesday announced that the Trump administration will challenge the ability of federal district court judges to issue nation-wide injunctions.

Pence argued to supporters at an event hosted by the conservative Federalist Society that the Trump administration has been “unfairly” targeted by injunctions issued by lower courts.

The vice president said that in the coming days, administration officials will seek pathways to put the issue before the Supreme Court.

“So I say to all those gathered here, for the sake of our liberty, our security, our prosperity and the separation of powers, this era of judicial activism must come to an end,” Pence said. “The Supreme Court of the United States must clarify that district judges can decide no more than the cases before them.”

The Trump administration has repeatedly seen some of its most controversial policies, like a travel ban for several Muslim-majority countries and a ban on transgender service members in the military, blocked by national injunctions but then upheld by the Supreme Court.

Good.

No judge should be able to set policy for the whole country.

That defeats the whole purpose of the representative republic form of government that was established with its system of checks and balances.

As they should. “Forum shopping” especially at Federal DC level is foolish and unethical. Judges should be prevented from abusing their positions by usurping power not properly belonging to them.

If a DC judge thinks something is unconstitutional, then let him/her/it apply it as the district level. They are district judges, not national judges.

Same for the Circuit Courts.

I believe only the SC has jurisdiction at the federal level. Allowing other courts jurisdiction defeats the fundamental purpose of our founding. Only the Supremes should possess that type of power and to tell the truth with politics in the state it is .... the Supremes worry me too

WTF! Why waiting. While the Federal Courts burn America down, the House, when we had it, Senate and the President did nothing to haul them in. It is still going on. Remember talk, talk, talk, and more buss shi! talk. At this rate America is finished.

Exactly. This practice of nationwide injunctions boggles my mind - it’s 180 degrees opposite of what used to be taught in Con Law 101 back in my day.

District Court injunctions apply in that District; Circuit Court injunctions in the states included in that Circuit. Pretty basic stuff, but completely blown past by activist jurists.

Supreme Court needs to draw a line in the sand here.

Controversial from who's point of view? My grandfather, God Rest His Soul, was a life long Democrat and wouldn't find these policies controversial.
