How President Trump can use 14th Amendment to put citizenship question back on the 2020 Census
American Thinker ^ | 07/05/2019 | Thomas Lifson

President Trump holds winning cards on the census citizenship question, both politically and legally. An overwhelming majority, 67% of Americans, see such a question as legitimate, and those who want to obscure the difference between citizens and non-citizens have an argument that will not add to the ranks of those voting Democrat in the 2020 presidential race. Moreover, despite media spin (“American pride has hit an all-time low, a poll finds”), emphasizing the increase in the number of Americans who aren’t proud (almost all of the increase among Democrats who only love America when a Democrat is president), fully 72% of Americans are “extremely proud” or “very proud” of being an American.

With progressives increasingly defining themselves as anti-American and the Democrats’ presidential field intimidated by the left extreme of their base, President Trump’s struggle to include a citizenship question can be positioned as a fight for the interests of Americans in contrast to the interests of border violators. Especially in light of a convincing legal strategy that somehow escaped the notice of the Solicitor General of the United States, Noel Francisco, whose office argues the federal government’s cases in court.

Section 2 of the 14th Amendment provides that if a state denies the franchise to anyone eligible to vote, its allotment of House seats shall be “reduced in the proportion which the number of such . . . citizens shall bear to the whole number of . . . citizens . . . in such state.” This language is absolute and mandatory. Compliance is impossible without counting how many citizens live in each state.

This makes senses and should be a sound legal argument.

Am I correct that answering the Official Census questions intentionally incorrectly is actually a crime?

SO any illegal alien who fills out a census and checks ‘Citizen’ will be guilty of yet ANOTHER crime ...

The Dems are trying to pack the darkland districts with illegal immigrant they will one way or another allow to vote (for dems, the sugar daddies of course)-— The Census’s primary reason to exist is to periodically (every 10 years) apportion voting districts.

Seriously, it is time to loudly tell off anyone who has a problem with that citizenship question being included AND question their loyalty to this country and fairness to THE US CITIZEN, rather than trying to destroy this country by pandering to illegal voters/leftist power tactics.

Yet another reason we need the law.

Democrat Rep. Veronica Escobar (TX) is secretly sending staff to Mexico to find and coach migrants who are trying to enter the United States and is instructing them how to “exploit a loophole” to game the asylum process, multiple U.S. Customs and Border Protection (CBP) officials allege.

Thank you Amendment 10. Is the Congressional Globe of 1868 the equivalent of today’s Congressional Record?

Sounds also like a great way to reduce California’s Congressional delegation.

When I get the questionnaire, I’m going to write that I am a US citizen in big bold red letters. Make sure they see it at the return center.

Still MAGA as too many initiatives are incomplete, beginning with the wall and importantly deporting 30-60 million illegals, ending H1B and booting millions of Indians, as a few starters.

Here’s how Trump can get the question in NOW, even before SCOTUS has a final say.

Currently, the only thing stopping him is NOT any provision in the Constitution, but a clause in a federal law which says agency changes must be reasonably decided, and Trump has been told to show this is the case.

But Trump is the one enforcing such laws and I don’t see anything stopping him from issuing an EO saying that any agency changes under court review shall be considered to be reasonably decided during that process, including any appeals up to and including SCOTUS, and any adverse court rulings will affect future agency actions (2030 census), but not any changes already implemented during the review process.

I think it’s entirely his prerogative, as President, to enforce the Administrative Act in this fashion, and that would put the question in now.

"Opponents would choose a federal district court likely to block it again"

What if a friendly party (playing devil's advocate) sued in a friendly court to beat them to the punch?

I’m extremely proud of America no matter the president. America is the last bastion of freedom in a world steeped in tyranny and oppression of the human spirit.
