The Constitution specifically grants EXCLUSIVE and UNFETTERED authority to Congress to establish the uniform rule of Naturalization. It is an enumerated power of Congress under Article 1, Section 8, clause 4.

So

1) Congress gets to decide - everything regarding naturalization. Who can come in, who can not. Who is a citizen, who is not. Who needs to be naturalized and who does not. What hoops a non-citizen needs to jump through in order to become a citizen. PERIOD. Neither the courts nor the States have any authority to change that.

2) I am of the opinion that any federal judge who directly attempts to reduce or contravene the Constitutional authority of Congress can and SHOULD be impeached and removed from their office.

Actually, Congress completely surrendered its authority on that specific issue to the President.

8 U.S.C. §1182(f)

“Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.”

Unfortunately, Trump has only used that authority one time.

The Political Left went straight to a friendly judge and got a friendly injunction.

Trump sent Deep State, career, DOJ lawyers into court to defend case.

As expected, Trump's lawyers have accomplished nothing.

They will still be litigating in 2024 if Trump is still President.
