Trump judicial pick breaks down in tears at hearing over legal group's attack
Fox News ^ | October 30, 2019 | Ronn Blitzer

One of President Trump's nominees for the Ninth Circuit Court of Appeals broke down in tears during a Senate Judiciary Committee hearing Wednesday, as he disputed suggestions that he would not be fair to members of the LGBTQ community.

Lawrence VanDyke was the subject of a scathing letter from the American Bar Association, sent to committee leadership Tuesday night, which alleged that people they interviewed expressed this concern, and that VanDyke himself "would not say affirmatively that he would be fair to any litigant before him, notably members of the LGBTQ community."

But conservatives have adamantly defended the nominee. And when asked about this at Wednesday's hearing, VanDyke strongly disputed the ABA's account.

"I did not say that," VanDyke told Sen. Josh Hawley, R-Mo., tears welling up in his eyes.

"No, I did not say that. I do not believe that. It is a fundamental belief of mine that all people are created in the image of God. They should all be treated with dignity and respect, senator," he added, sobbing.

VanDyke also said that he was not given a fair opportunity to respond to the allegations during his ABA interview. He said when he was confronted with the concerns about his views, he began to answer but was told they were running out of time.

That interview was conducted by Marcia Davenport, the lead evaluator. Hawley noted that Davenport once contributed to the campaign of a judicial candidate who was running against VanDyke.

"I find that absolutely unbelievable," Hawley said, stating it "probably explains the totally ad hominem nature of this disgraceful letter."

The paragraph preceding the questioning of his attitude toward LGBTQ litigants included a list of other complaints against VanDyke, attributed to "the assessments of interviewees," without detailing who or how many.

For those people on here beating their chests and acting like manliness is a pre-requisite for a jurist, maybe you should actually read up on who this man is and what his views are before you so easily toss him aside as too much of a wimp for the bench. His rulings have been anything but soft. He is a staunch conservative, which is why the ABA is fighting him so hard. Keep your priorities straight and don’t get sidetracked.

Those people always stun me. There is something, some essential goodness I am used to recognizing in people, often hidden a bit but there at the bottom. That part is the common humanity that allows for human intercourse. The absence is like recognizing an alien or Lucifer.

Our society now has more & more people that have a hole where that part should be. Many such are found as gang members, psychopaths and Leftists. There is no reasoning with such people or even attempting to deal with them except from a position of strength since they have no compunctions.

There is no doubt in my mind that if the Democrats get control of Congress and the Presidency, one of the first things will be that they will work with the ABA to promulgate a new “Ethics Code,” expressly requiring all judges and lawyers to affirm LGBTQIXYZ. They want to force Christians out of the legal profession in the worst way.

Excellent point.
He’s over the target, drawing flack and doesn’t require friendly fire as well. If that’s how we support Conservative judges we deserve what we get, the judges the Left approves of.

wow ... reacting emotionally to an underhanded,below-the-belt attack is grounds not to confirm? Like Kavanaugh reacted emotionally? He shouldn’t have been confirmed?

A male candidate sobbing? That alone tells you he would go along with any LGBTQWERTY crap that came before him.

The macho responses here must be from men whose reputations don’t mean much to them, or who have never been the subject of a vicious, unfounded attack on their reputation.

the Heritage Foundation

Judicial Appointment Tracker

Please look at the detail mid-page, with emphasis on numbers of nominees who were approved with larger than 25% objections.

It’s shocking when compared to our other president’s nominees.

Thanks; a reasonable point.

So give me the cliff’s notes version by answering a few questions.

Would you say that he is a strong supporter of individual civil rights? 1, 2, 4, 5, 6, 10th amendments?
Would you say that he believes that the federal government has expanded far, far past the constitutionally enumerated powers? Any decisions to support State’s rights?

Any key decisions would be great.

Those numbers are are out of sight compared to other Presidents.

Thanks!
