Trump Impeachment Trial in Doubt as Democrats Weigh Withholding Articles

WASHINGTON — The day after the House cast historic votes to impeach President Trump, Speaker Nancy Pelosi put an abrupt halt on the proceedings, holding back from sending the charges to the Republican-led Senate in a politically risky bid to exert influence over the contours of an election-year trial.

With some leading Democrats pushing to delay transmittal of the articles and others advocating that they be withheld altogether, the limbo is likely to persist until the new year. The House left town on Thursday for a two-week holiday recess without taking the votes to appoint impeachment managers, which is required to start the process in the Senate.

“We are ready,” said Ms. Pelosi, who has said she would not send the charges or name the lawmakers who would prosecute the case against Mr. Trump until she was certain of a fair process for a Senate trial. “When we see what they have, we will know who and how many we will send over.”

By withholding the articles, Ms. Pelosi is hoping that Mr. Trump — who is eager for a trial to present his defense and clear his name — will put pressure on Senator Mitch McConnell, Republican of Kentucky and the majority leader, to commit to Democratic demands, including the ability to call witnesses during the trial.

But the speaker’s strategy is also a gamble. Having toiled to present the House impeachment inquiry and the votes on Wednesday as a somber duty rooted in the Constitution, Ms. Pelosi risks appearing to politicize the matter if she withholds the charges for negotiating leverage.

And Mr. McConnell was entirely unmoved by Ms. Pelosi’s tactics, delivering a speech on Thursday evening in which he appeared barely able to contain his amusement at what he regarded as the speaker’s missteps.

She can't withhold the indictments legally. That obstructs justice". Trump needs to clear his name and she needs to follow the process. Otherwise it's an "abuse of power. If it follows there was no laws broken as indicated by a guilty verdict then someone "lied to Congress.

This is their strategy, mark it.

They do not want their sham “impeachment” articles to be blown out of the water and shown for what they are, and for their unconstitutional slimy process to be exposed.

they want to claim they impeached him, but they don’t want the senate to destroy the charges and ‘acquit’ thereby vindicating Trump.

So they will not transmit the charges to the senate.

They will run on ‘they impeached him’.

The fact they cant demand the senate do anything they want is the false narrative and false excuse for not doing their constitutional job of now sending the charges over to the senate.

They onow if they go to trial and have witnesses cross examined, and defense witnesses called it will be very bad. As in criminal charges bad for Hunter and other. Like Clinton Foundation people. Like Billary Clinton. Obama. Rtc.

Today I read this from New Jersey Joe

McConnell should declare something like this:

“Because the articles of impeachment have been made publicly available, the Senate deems them ‘delivered’ — the House has six hours for their managers to present themselves to participate in the process. Otherwise, we will begin without them, and no one will be allowed to join the process once we’ve started.”

There is no precedence for withholding them. Pelosi is trying to unconstitutionally control the trial in the Senate.

Following adoption of the articles of impeachment, the House adopts resolutions appointing managers to present the articles before the Senate, notifying the Senate of the adoption of articles and appointment of managers, and authorizing the managers to prepare for and to conduct the trial in the Senate.

Until notification to the Senate, by the House, is made, the adopted articles of Impeachment are not formal. Such notification may be delayed as long as the next Congressional Session.

Until the Senate is informed formally and managers appointed by a filed resolution to the Senate, the Senate may ignore the House
resolutions of Impeachment.

If the Congressional session expires, then new managers have to be appointed by a new House Resolution in the next session. The adopted Articles of Impeachment, however do not have to be readopted but have to be filed no later than the end of the next session.

Pelosi says she may hold up the Impeachment trial process in order to wring certain concessions from the Republicans. Pardon me, but isn’t that quid pro quo? When does Nancy’s impeachment begin? I believe she is demanding a quid pro quo, which is an obstruction of justice and a misuse of her office. Does any of this sound familiar?

Trump goes to SCOTUS as a friend of the articles and asks the court to protect the articles. Protection is to release to the Senate. The MSM will have exploding heads everywhere
