Legislation pre-filed in New York by State Senator James Sanders (D-10th Senate District) will require anyone wishing to purchase a firearm to first pass a mental health evaluation.
Senate Bill 7065 has been referred to the New York Senate Consumer Protection Committee where it awaits a hearing.Current New York law requires the use of a licensed firearms dealer and passage of a federal background (NICS) check to transfer any firearm.
SB 7065 would require the mental health check prior to initiating the background check.
The implementation of a mental health evaluation for firearm transfers constitutes unprecedented government regulation and overreach. The mental health requirement would even apply to a father giving a treasured firearm to his son or daughter.
Violators of the new law would face non-violent Class D felony charges and up to 7 years in prison. Some other non-violent Class D felonies in New York include robbery, burglary and vehicular manslaughter. If you are convicted of any felony, you lose your right to own a firearm and your right to vote.

IF that is allowed then ANYTHING that can be used as a weapon will require mental health evaluation to purchase, knives, cars, baseball bats, Metal Tea cups (Riddick), plastic bags, rope, propane- you name it-
There should be both a mental and civics exam before one is allowed to vote.
Name me one mental health evaluation that works with someone who is deliberately lying and not subject to observation.
These things only work with the cooperative or someone who can be observed in custody over an extended period of time.

Under this bill, a completely 100% law abiding citizen who has never been accused, let alone convicted, of a crime (DV or otherwise) will be required to undergo a mental health exam just to buy a gun.
That's even more egregious than the situation you describe.
Meanwhile, it’s possible for someone to be clinically nuts and legally sane at the same time.
Ex: The legislature.

Every single evaluation would indicate the applicant is crazy for wanting a firearm...and you would have to pay at least $1000 for the evaluation.
In other words guilty until proven innocent? Citizens would have to prove they are mentally fit first, the state would assume not... Utter BS. Why would anyone have to prove their ability to exercise a right? Hey, how about a grammar test prior to allowing someone to exercise their right to free speech? I know a few people on social media I’d never hear from again...
Lets have mental health checks for politicians and journalists first.
