Legislation pre-filed in New York by State Senator James Sanders (D-10th Senate District) will require anyone wishing to purchase a firearm to first pass a mental health evaluation.
Senate Bill 7065 has been referred to the New York Senate Consumer Protection Committee where it awaits a hearing.Current New York law requires the use of a licensed firearms dealer and passage of a federal background (NICS) check to transfer any firearm.
SB 7065 would require the mental health check prior to initiating the background check.
The implementation of a mental health evaluation for firearm transfers constitutes unprecedented government regulation and overreach. The mental health requirement would even apply to a father giving a treasured firearm to his son or daughter.
Violators of the new law would face non-violent Class D felony charges and up to 7 years in prison. Some other non-violent Class D felonies in New York include robbery, burglary and vehicular manslaughter. If you are convicted of any felony, you lose your right to own a firearm and your right to vote.

I dont see how it would run afoul of the privacy act. Theyll simply require you to sign a waiver as part of the application process. Remember, in New York the second amendment is a privilege not a right.
Catch-22
You must be crazy if you want to buy a gun.
...and you can’t sell a gun to someone who is crazy.
Bill is miss numbered. It should be Catch 22.
Most psychologists will refuse to do this for liability reasons. The few who will do it will do so for political reasons and reject most applicants based on the lie that those who want a gun are by definition insane.
And wanting to buy a gun is probably one strike against you.
1) Do you believe in God? Yes.
2) Do you believe in the Constitution? Yes
3) Do you believe that marriage is between a man and a woman?
4) Do you own a Bible? Yes
5) What is your political affiliation? Conservative.
Your application is rejected and remand you to the custody of a state mental health facility.
Doubtful it will withstand a court challenge.
More shame on anti-American New York. As many of us have seen around universities, most psychologists are crazed commies from disfunctional families.
Most mental health “professionals” have a myriad of unresolved issues.
