Dad Fatally Shoots Man Following And Harassing His Family Outside Restaurant

VIRGINIA BEACH, VIRGINIA — The unidentified shooter was out enjoying dinner with his family. As they exited the restaurant a man confronted the family and became aggressive with them. After asking the man to leave them alone numerous times with no result, dad finally took action.

A Chesapeake man was shot and killed by a member of a family he approached “aggressively” outside a Mexican restaurant in Virginia Beach Friday night, police said. The family had told the man to leave them alone, said police spokeswoman Tonya Pierce. Brian Orlando Hicks, 37, died on scene at the parking lot outside El Azteca, a longtime restaurant in Pembroke East Shoppes.

The man who shot and killed Hicks waited on scene for police to arrive and was released later after being questioned by detectives, police said, describing the incident as a confrontation between the two men. Pierce said Hicks was “verbally aggressive” and continued to follow the family despite being told to stop. (Via Pilot Online)

VA Beach is pretty conservative as cities of 450k go. Large military presence there.

I was told by a CC instructer that the average cost of a justified shooting is $20,000. That was four years ago.

He was defending his family. The reasonableness of defense of another is determined by the threat to those being defended. I have personally gotten someone acquitted from a murder charge on that basis, and I wasn't the defense attorney.

I had asked a judge what kind of trial he had in progress, he told me, and I immediately realized that the defense attorney had overlooked this defense. I found the appropriate jury instruction on the spot, showed it to the judge, and he brought it up at his next conference with the DA and defense attorney. This was argued to the jury and they acquitted the defendant on that basis.

Dear, please never attempt such a cleaning of a death scene. How would you do that? You think bleach and alcohol will cover it all? Crime Unit Investigators have techniques you've never heard of, even in TV shows. They WILL find the cover-up and you will be prosecuted for that alone. Please don't do that in CA.

I didn't want to spell it out, but here is our home invasion protocol that I hope you think about.

1. Have motion sensors on all outside entries and gates. Really cheap at Home Depot.
2. When you see potential invaders moving around outside, immediately go to a room you can lock and call 911. Best to have landlines in every room. Tell the Emergency Operator your situation and "in fear for your life". DO NOT MENTION ANYTHING ABOUT A WEAPON, unless asked.
3. Keep that line open even if you have to lay it down as you deal with other stuff. Very important.
5. THE most accepted home defense weapon in CA is a shotgun. Recommend you get one and practice at a range.
6. Unless you have urban combat experience, NEVER EVER go looking for the intruders. That includes even if your weapon of choice has a light/laser system. Stay in you locked room with your weapon pointing at the door.
7. Let them steal your stuff. Better than killing a simple thief and living with that, and living with the legal matters.
