I was thinking about that, too. I guess it depends where and who you are. This man felt he had no reason to believe these officers would screw him over.
Wrongful death claims are tiny compared with a live victim. Many states even limit wrongful death and typically all proceeds have to be split among heirs at law and limit attorney fees. Hence, a bum with not income loss might be workth $75000 in Ohio. A broken arm three times that. Loss of an eye 10 times death claim.
Just sayin it makes good money sense to make sure they are DOA.

The local DA makes the final decision whether to take it to a Grand Jury, and either prosecute or dismiss as justified.
I live close to a red/blue county border. Just yesterday, early morning, I needed to do (yet another) supply run in preparation for what’s coming with Coronavirus, so I took my ‘hardware’ and went shopping. But, instead of going to the nearest store, in my county, I drove a bit more and went to the same one in a Red County (I won’t name the store, since I don’t admit to going there). No problems, but at least I knew that I wouldn’t have to deal with a Soros-placed DA, had something gone wrong. And, likewise, the perps, who may have been tempted to target my vehicle, likely had the same considerations, and know that they’re much better off in a Blue County.
Have they left out the part about Dad’s MAGA cap? I’m asking for a friend.

The legal seems to be done. The civil will begin soon if the bums family is around? Doesn’t matter in this day and age if you’re right or wrong. Someone’s getting a lawyer. I hope that doesn’t happen. And, will this add more fuel to the demodrone fires to further restrict firearms in VA?

Can cops stop witnesses with cameras from taping such out in the open interviewing? Even someone with a phone, audio recording in shirt pocket can be useful if they are close enough to hear.

3) I need medical attention, I am having trouble breathing.

Depends if Virginia has a "stand your ground" law like Florida does. Here in the Socialist Republic of California, you better make sure the intruder is in your home before you take deadly action. Outside or partially inside the window or other opening is not a defense in CA.
That's why the wife and I have a specific protocol for home invasion. I won't give specifics, but it is within CA law. And no, I won't talk to the authorities without an attorney present.
No idea, I don’t claim to know the self-defense laws all over the US. :P Was just pointing out that assuming one’s home state self-defense laws and doctrines apply in another state is not a good idea.
Here’s a sample of the Texas law regarding deadly force in defense of property, which wouldn’t apply in many other states:
Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:
(1) if he would be justified in using force against the other under Section 9.41; and
(2) when and to the degree he reasonably believes the deadly force is immediately necessary:
(A) to prevent the other’s imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or recovered by any other means; or
(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

Yes, the above does mean that in Texas, if someone steals your wallet through force or threat of force and runs you are perfectly justified in shooting the perp in the back of the head to get your wallet back.

If the attacker was on PCP they can be VERY DANGEROUS without a weapon!!
However nothing you say can be used for you because it is "hearsay".

The man might have gotten lucky. Or in a couple of weeks he might be charged with murder and on trial for his life.
You do what you want. I am calling the lawyer who's number I have in my wallet and keeping my mouth shut except for "I was in fear for my life and I want to call my lawyer."
