The article states “After the shooting, dad called police and waited for them to arrive. This is so important to do for anyone involved in a defensive shooting. When police arrived he fully cooperated. After interviewing dad, the police released him without pressing charges. The shooting was determined to be a defensive action.”
I have read that the opposite is true: One should never talk to the police after such an event unless one’s attorney is present. Without an attorney present it’s your word against that of the police.
Don’t talk to the police. Worthwhile (and humorous) video.

I think the operative word here is witnesses...cops can’t trap you if too many people would back up your story. No witnesses, keep your mouth shut until the lawyer comes.
Tell them only that you felt your life was in danger. Ask to speak with an attorney.
I was thinking about that, too. I guess it depends where and who you are. This man felt he had no reason to believe these officers would screw him over.
You can say a little.
Show DL and CCW. No furtive movements to first cops on scene:
1) That man attacked me.
2) I was in fear for my life
3) I need medical attention, I am having trouble breathing.
4) I'll be happy to help your investigation, but ONLY with my attorney present.
Say nothing else.
However nothing you say can be used for you because it is "hearsay".
Funny how that works.
The man might have gotten lucky. Or in a couple of weeks he might be charged with murder and on trial for his life.
You do what you want. I am calling the lawyer who's number I have in my wallet and keeping my mouth shut except for "I was in fear for my life and I want to call my lawyer."
...if I can remember to do so, I will shout something like I FEAR FOR MY LIFE!
I’ve read that one should ask for medical attention. You are experiencing rapid heart beat and shortness of breath, both of which are likely true if you are an average citizen. Otherwise you are just too rattled to talk to the police.
“When police arrived he fully cooperated”
I can not disagree more.
The Police have an agenda - It MIGHT be to make an example of you. Do not talk to the police until you have spoken with an attorney and have the attorney present.
I printed and laminated the following and store it right under my LTC card in my wallet:
Im looking forward to cooperating with you and any assigned investigators after I have an opportunity to consult with my lawyer. As of now, I do not consent to any search whatsoever or to be questioned. As such, I do not consent to a search of my premises, my person, my immediate location or any vehicle or effects. I hereby exercise my rights as enumerated by the Fourth, Fifth, Sixth, Ninth and Fourteenth Amendments to the United States Constitution. I am requesting to have my attorney present prior to and throughout any questioning at all. Additionally, I request to call my attorney right now for a private legal consultation. - - Am I free to go?
Ditto.
And this is not Texas after all.
