We Have a Constitution Not a King: Cuomo Rejects Trump's Claim of Total Authority to Lift Shutdowns

New York Governor Andrew Cuomo has rebuked President Trump's claims that he has blanket authority to order a reopening of the country. In a heated press conference inside the White House on Monday evening, Trump asserted that his office holds 'absolute power' over the shutdowns But Cuomo said later Monday that the last time he checked the US had 'a constitution...not a king'. The governor went on to accuse Trump of an 'abrogation of the Constitution', before threatening the president with a lawsuit should he put New Yorkers at risk. 'The close down was left to the governors to do individually state by state. Now the reopen should be total authority? That makes no sense,' Cuomo said. In a heated press briefing, Trump launched a furious attack on the media and screened a White House-produced video praising his response to the virus.

We’re sailing into unchartered waters. The courts have ruled that state legislatures, mayors, Indian tribes and sheriffs, etc. are sovereigns.

I imagine it will take a decade or more for the courts and legislatures to sort out who or what is sovereign over whom or what.

NJ has a similar order in place. Now a number of hospitals are creating their own DNR and No CPR policies on Covid positive or SUSPECTED positive patients. This is not to prioritize patients over other patients, but to prioritize healthcare workers above patients. Guess we won’t need those ventilators after all.

I too bristled when I heard POTUS repeated use those words.

He should have explained what he meant. That is, under the emergency orders in effect, he does, indeed, have dictator powers. Frankly, the statement that he, or any president, has authority over the governors scares the hell out of me.

The "productivity" of American cities is an accounting fiction based on the wide latitude of where you can realize revenue. No America city can feed itself, provide its own electrical power, or dispose of its garbage. Few can produce their own water or dispose of their sewage.

Trump has the DildoCrat leaders boxed in. At this point, they will not attempt to reopen prematurely, and because of their festering stupidity, their cities will be the last areas ready to reopen.

The red/blue map of how counties voted in the 2016 Presidential Election will be illustrative.

Red counties will soon be ready to reopen and productivity will soar. Out of spite, and because DildoCrats grossly mis-manage densely populated areas creating high rates of infection, the blue counties will remain largely shuttered.

Unfortunately, it is too much to hope for that the slaves on the DildoCrat plantations will rise up and dispose of their elected leaders. Probably because the garbage dump is so far beyond the city limits.

This is not a popular stand for Trump. If seen as delaying opening in areas with light or no cv, this is not going to be taken well by the millions suffering economically. Initially White House issued guidelines, governors set specifics. He needs to take a deep breath and rethink this stance.

The truth is the US is under a state of emergency...

That is the key point. Once the emergency declarations were made the power of the executive branch increases. The total extent of that power can be seen from early examples of the use of federal powers, such as Washington's actions during the Whiskey Rebellion. Lincoln's actions in the mid 1800s provide another example of the power of the executive branch versus that of the states.

Gov. Cuomo should think about Gov. Brown's experience in Georgia in 1864 and afterwards in order to understand the full scope of the power of the federal government.

He explained that the powers were those of the presidency, not him in particular, and that they were in the context of this emergency only.

Don't be fooled by Trump's mastery at trolling the media and the Democrats. He will almost certainly recommend re-opening first in areas with low COVID-19 infection rates, which are mostly deep red counties in rural America that are full of Trump voters.

Stupidly, Gov. Cuomo and his pals are saying that they will sue the government is President Trump orders them to open too soon. But realistically they will be the last states allowed to re-open. So Gov. Cuomo and his fellow Democrats have set themselves up to take the heat from their voters who will be sitting at home when the largely Republican rural areas are back to work.

By the time the epidemic subsides in the Democrat strongholds the rest of the country may well be back to normal. The challenge will be to keep the largely liberal population of the areas with significant infection separate from the rest of the country.

Not at all surprising, these faux-king governors are not going to give up their expansive self-anointed new power without a fight. They’ve hadincredible power over their subjects for nearly a month now ... and ... well ... you know how addictive power is to a politician, especially a politician on the Democrat/Left whose sole purpose in life is to accumulate it.
