Maybe he could have said that all depends on information uncovered, instead of ruling it out altogether from the beginning. He has to know that this is not any rogue operation by people in the FBI, CIA etc., it had to have been approved at the top of the chain of command. Yes, a VP can be charged while in office if he commits a crime of his own initiative.
However, if he acts on direction of POTUS, POTUS’s immunity extends to him...and/or every other member of the executive branch.
