Pardon Michael Flynn. Time for the President to end this highly politicized prosecution.
Wall Street Journal ^ | July 10, 2020 | WSJ Editorial Board

Posted on 07/11/2020 1:15:57 PM PDT by karpov

The prosecution of former National Security Adviser Michael Flynn has already exposed the bad faith of the FBI and Justice Department in pursuing him even when they knew there was no basis for an investigation. Now federal Judge Emmet Sullivan is continuing the legal torture by appealing an order from a panel of the D.C. Circuit Court of Appeals to drop the charges. President Trump should step in now and end this farce by pardoning Mr. Flynn.

In an honest process, Judge Sullivan would have signed off on dropping charges once prosecutors and the defense agreed there is no case to adjudicate. He refused. Mr. Flynn then sought a writ of mandamus from the D.C. Circuit, and he prevailed in a 2-1 opinion that ordered Judge Sullivan to dismiss the case.

Judge Sullivan is now refusing again by requesting this week an en banc review of the writ by the full D.C. Circuit. Though we don’t know whether the full court will take the appeal, remember that Senate Democrats and Barack Obama packed the D.C. Circuit with liberal judges after ending the judicial filibuster on a partisan Senate vote in 2013.

Judge Sullivan knows that once the court takes the case en banc, the panel opinion is immediately vacated under D.C. Circuit rules. That means the writ ordering him to dismiss vanishes, and the eventual en banc ruling would control. Mr. Flynn’s legal agony would continue for months and perhaps until a Biden Administration takes office.

This is outrageous and continues the politicized nature of this sorry prosecution. The review of the Flynn case ordered by Attorney General Bill Barr found the FBI and Justice Department withheld exculpatory evidence, revised the bureau’s 302 interview forms, and did an end run around normal White House procedures to sandbag Mr. Flynn.

I believe a pardon still leaves him unable to get a government job working again in Trump’s administration.

actually, if there is anything, anyone that
is more important to show the importance of
a military takeover, followed
by capitol Trials of seditious blackrobes
it is dirty Judge (”I am the King”) Emmet Sullivan
(and his kin).

Pardon means “guilty”. No, let this play out and rub the deep states noses in it.

WSJ wants him to be guilty.

It is part of the strategy of the Left to push President Trump into pardoning General Flynn. Then they can claim he was always guilty and President Trump pardoned him for partisan purposes.

A pardon would be the worst thing to do.

Let it play out and expose the corruption.

General Flynn can sue the pants off the government for prosecutorial misconduct.

If he is pardoned all that disappears.

A good strategy, being followed by Sidney Powell, is to keep putting out the exculpatory evidence that has been withheld.

It keeps showing the magnitude of the frame-up of General Flynn.

The Flynn team does not want the pardon. They have won the case so continue the legal process so you can sue them after the case is dismissed with prejudice. A “pardon” still says you did something wrong. He did nothing wrong.

THIS is stupid. Granting a pardon means he was guilty of something of which he is not. Granting a pardon means he had to have done something wrong to have been pardoned for.

NO! Pursue the dropped charges direction until Judge Sullivan capitulates, and then General Flynn will truly be free.

Nope, this is dumb. General Michael Flynn is all but free of the Deep State.

A pardon cheats him of a full victory and legal opportunity to strike back.

Beyond fed up with people pushing a pardon. The Court of Appeals is likely to reject Judge Sullivan’s inept motion.

They could slap down Sullivan and this could end. To issue a pardon for General Flynn who is not asking for one is a double cross.

Can anyone tell me how long the DC Circuit has before they must make a decision on Sullivan’s request? I thought there was a 21 day deadline from the 3 panel decision (24 June 2020) to decide whether or not to hold an en banc hearing. That would make on or before July 15th for a decision. Can someone who understands these things tell me if that is correct? If not, when must they make a decision?

Investigate this Judge. His actions defy explainable behavior.

I don’t care if he has to be waterboarded to find out who his masters are.

No, I think the case should be dismissed by the courts and the judge get a smackdown.

The pardon will always have a whiff of guilt where there shouldn’t be any. His justice needs to be his exoneration in court.

Flynn’s lawyer seems to have her ducks in a row.

I predict Sullivan loses. Sullivan gets bounced off this
case, Flynn totally cleared.

I would contribute to a real go fund me to pay for all the
Generals legal expenses and a better home.

I would love him to be in charge of Deep State Draining.

Fbi needs a broom and Flynn could sweep it clean.

Then Sullivan will file an appeal saying that the pardon is irrelevant to his proceeding because he wants to jail him for lying to him, or contempt, or any other random thing he can think of.

I poop you not. Its Lawfare. Anything to delay.

Maybe Sydney Powell should ask for the discovery order against Eric Holder's law firm to be fulfilled. As long as we are waiting for the next proceeding date to roll by...
