Dems threaten to pack Supreme Court if Trump gets nominee confirmed

As President Trump moves to nominate a candidate to fill the seat of Justice Ruth Bader Ginsburg, who died Friday, there are a growing number of Democrats threatening to implement a radical strategy and pack the Supreme Court if they take control of the White House and the Senate.

“If he holds a vote in 2020, we pack the court in 2021,” Rep. Joe Kennedy III, D-Mass., tweeted on Saturday. “It’s that simple.”

“Mitch McConnell set the precedent. No Supreme Court vacancies filled in an election year. If he violates it, when Democrats control the Senate in the next Congress, we must abolish the filibuster and expand the Supreme Court,” Sen. Ed Markey, D-Mass., tweeted.

The idea of “packing” the court with extra justices -- attempted unsuccessfully by President Franklin Delano Roosevelt in 1937 to force through parts of his New Deal that were ruled unconstitutional by the high court -- has bubbled away on the fringes of the party for years.

Currently 9 Justices are in charge of 13 District Courts.

https://upload.wikimedia.org/wikipedia/commons/d/df/US_Court_of_Appeals_and_District_Court_map.svg

The number of justices does need to be increased to 13, with a major reorganization of the courts.

For example, the 9th Circuit is way too large, by population, so needs to be subdivided.

And the SCOTUS can only hear 100-150 of the more than 7,000 cases appealed to them every year. And sadly, many of these “slots” are taken up by redundant and frivolous cases.

For example, the SCOTUS agreed to hear the ridiculous “Bong Hits For Jesus” case, from Alaska, TWICE. The justices love to waste time on lawsuits against public schools from irate parents and local agitators. So cases of that sort are heard again and again, never with any sort of final resolution.

The Judiciary committees need to put their foot down with a great list of lawsuits for which there is zero abiding federal interest, no matter how craftily phrased to appear to have one. Thus federal courts should reject and return them for the state courts to decide.

We are now ruled by an assemblage of far left royals and aristocrats known as the Federal judiciary. Democracy would be an upgrade.

In response then Trump should threaten to raise it to 20 during his next term.

So the Democrats need a trifecta to pack the courts?

If that’s the case, it’s a great issues for Republican House challengers in red/purple districts, such as Burgess Owens in Utah.

If Supreme Court Justices followed our Constitution instead of twisting interpretations to enable ideological agendas, this would be a non issue. Basically, the dems are saying they will pack the court with Justices that will rule in their favor no matter what our Constitution says.

Yes, they would need both houses of Congress and the Presidency.

I’m not sure how totalitarian got thrown in there. Totalitarianism is a system where a dictator or oligarchy imposes certain views on the populace by employing an army of secret police and punishing those who dissent from those views with sentence ranging from public humiliation all the way up to execution via torture. Referendums are merely elections where laws rather than politicians go up for a vote. An example of a referendum in Switzerland:

https://en.wikipedia.org/wiki/2009_Swiss_minaret_referendum
[The federal popular initiative “against the construction of minarets” was a successful popular initiative in Switzerland to prevent the construction of minarets on mosques. In a November 2009 referendum, a constitutional amendment banning the construction of new minarets was approved by 57.5% of the participating voters.[1] Only three of the twenty Swiss cantons and one half canton,[2] mostly in the French-speaking part of Switzerland, opposed the initiative.

This referendum originates from action on 1 May 2007, when a group of right of centre politicians mainly from the Swiss People’s Party and the Federal Democratic Union, the Egerkinger Komittee (”Egerkingen Committee”) launched a federal popular initiative that sought a constitutional ban on minarets. The minaret at the mosque of the local Turkish cultural association in Wangen bei Olten is the initial motivation for the initiative.

The Swiss government recommended that the proposed amendment be rejected as inconsistent with basic principles of the constitution.[3] But after the results were tabulated, the government immediately announced that the ban was in effect.[4] ]

This is what is going to happen whether 2021 or 2025 or whenever the Dim’s win the the Presidency and Senate and abolish the filibuster...

Demographics is destiny and the GOP is on the losing end of the demographic race...

These idiots did not learn when they ended the cloture rule for 60 votes because of senator Harry Ried. This will bite them on the ass as well. The Republicans will win and can pack the court with 9 new conservative justices for a total of 18 so liberals will never win again. How did court packing go for FDR? Democrats are so unhinged and stupid and will bring this country to blows until they stop the rhetoric or just get obliterated at the poles and on the streets if they don’t stop their violence. It will be met with more than they can handle or tolerate.

How did unilaterally abolishing the filibuster for presidential appointments work out for the democrats? Are they really too stupid to understand what goes around comes around?

The next time the democrats control the Presidency, the House and the Senate they will pack the Court regardless of what the Republicans do now. Then, the next time the Republicans control the Presidency and both houses of Congress they will retaliate by repacking the Court. Eventually, there will be more Supreme Court Justices than there are Congresscritters.

Trum needs to conterstrike here by outlining the follwing plan:

2. Add three more justices in 2021

That's a big IF! Whether Trump nominates a replacement SC justice now or he waits until he wins reelection and the Dems lose the House and more seats on the Senate, he will STILL be naming a new justice. Won't they have to change the Constitution to pack the court anyway??? How's that going to happen with a majority Conservative court? Bunch of crybaby losers!

Can you imagine the uproar had the Republicans threatened to do the same thing after Obama nominated Scalia’s replacement?! I sure am glad the Dems are all showing their true colors right before the election. It’s gonna make the choices so easy for the sane Americans that are still left.

That will start an escelation with every POTUS/Senate party change adding enough seats to change the idealogical balance.

Just like impeachment will now be automatic when the House majority party is different from POTUS’.
