NC’s mail-in ballot acceptance extension OK'd by US courts, but fight could go to Supreme Court

North Carolina's mail-in ballot acceptance deadline can be pushed back, a U.S. Court of Appeals ruled Tuesday night, but opponents of a deadline extension could try to take their fight to the Supreme Court.

“All ballots must still be mailed on or before Election Day,” the ruling states, according to the News & Observer. “The change is simply an extension from three to nine days after Election Day for a timely ballot to be received and counted."

If the ballot is mailed by election day, how is this not legitimate. There has to be an endpoint to arrival rules. You can’t hold up the result waiting for weeks, but this is really not a big deal. The person voted by end of day election day.

The only reason we oppose this is we think they will be Dem votes. We are seeing rather large GOP VBM results coming in. Why is this opposed?

The question is, how do you know the ballot was mailed on or before Nov.3? I have heard conflicting information about postmarks. Some say, pre-paid mail such as ballots do not receive a postmark. I don’t know if that is true or not. What happens if ballots are found outside their mailing envelopes? How do you prove when they were mailed?

The court of appeals is not the legislature. The constitution says the state legislatures determine the rules. The ‘court’ can go pound sand. They don’t get to make law or change laws. Period.

Judge Wilkinson, Judge Niemeyer, and Judge Agee voted to grant the motions for injunction.

Judge Wynn wrote an opinion on the denial of emergency injunctive relief. Judge Motz wrote a concurring opinion. Judge Wilkinson and Judge Agee wrote a dissenting opinion in which Judge Niemeyer joined. Judge Niemeyer wrote a separate dissenting opinion.
