U.S.A. –-(AmmoLand.com)- The Phoenix City Council has voted to pay $3 Million to settle the Ryan Whitaker police shooting lawsuit.
On 21 May 2020, Phoenix police answered an ambivalent noise complaint that was mischaracterized as a domestic disturbance. It was at about 10:53 p.m. The complainant was desperate to get some sleep. From the 9:11 call, in the 13 August AmmoLand article:
Complainant:
Yeah, and its getting really loud and they been doing it for the last hour. I gotta get it to work tomorrow, and I can't get no sleep.
These guys have been noisy constantly… Every time I come back, these guys are noisier than hell. Always fighting.
Dispatcher:
Okay does it sound like it's escalated to anything physical or still just sound verbal?
Complainant:
Oh. It could be physical, I..I could say yeah if that makes anybody hurry up on, get over here any faster.
Dispatcher:
Anything to indicate it might be physical?
Complainant:
I hear slamming of doors and… I don't know. Somebody could be gettin' thrown into a door for all I know. But I hear all kinds of banging.
The police go to the apartment. Officers take up positions on each side of the door, well separated. One officer knocks on the door, and announces “Phoenix police”, in a slightly elevated voice.
Ryan Whitaker answered the door, with a pistol held in his hand down at his side. He did so because of previous suspicious activity. It is a prudent thing to do. It would have been more prudent to determine who was outside, before opening the door. The police had moved to the sides of the door, which made them difficult to detect through the peephole.

There was a good sized demonstration in Phoenix.
It’s never a good idea to open a door when you know cops are right outside.
I do not think he knew they were cops
But the difference between me and those cops is that the guy should have said to himself "OK,just in case they *are* cops I'll open the door without a gun in my hand because if they are cops they just might shoot me".
I recently got a license to carry...my first one.I was stopped by the NY State Police in September for a minor violation (I paid a $50 fine). When the cop appeared at my window the first thing I said to him was "I don't know if I'm required to tell you this but I have a license to carry and I'm unarmed now". I did it so he would know that I recognized that he was in charge and I posed no threat to him. I didn't want him to get nervous and shoot me.
The guy in this case was *beyond* stupid...so stupid that his heirs shouldn't get a penny.

I disagree. They, *once*, in a slightly elevated voice, said "Phoenix Police", after knocking.
The girlfriend said she had no idea they were police.
The police officers moved to where a person looking through the peephole could not see them.
The victims had music playing inside.
It is perfectly plausible they never heard the "Phoenix Police".
Sorry...if this was brought to a criminal trial (against the cops) and I’m a juror I’m voting “not guilty” on all charges.That vote would be based on this video. And if I’m a juror in a civil trial I’m voting “not a nickel” for anyone.Again,based on the video.

And what percentage of those Council members could be considered Swamp Creatures? What percentage of those Council members have campaign donors who are tort lawyers?
The liability laws are insane.
The malpractice in this case was so off the charts, they got off easy.
The victim in this case broke no laws.
He never threatened any officer.
He never knew they were police until they accosted him, at his doorstep.
He immediately attempted to comply with their garbled commands.
He was shot from behind, by an officer he did not even know was there, without justification, as he was complying.
The officers then compounded their error by refusing to ask for immediate medical help.
And, it was all on video.
