Texas joins multistate coalition challenging California’s assault weapons ban

Texas has joined another multistate coalition defending Second Amendment rights, this time asking the Ninth Circuit Court of Appeals to strike down California’s assault weapons ban in the case of Miller v. Bonta.

California is appealing a recent decision by U.S. District Judge Roger Benitez, who ruled that the state’s 1989 ban violates the Second Amendment. Gov. Gavin Newsom said the ruling was “a direct threat to public safety and innocent Californians.”

But in his 94-page ruling, Benitez wrote that the California law “bans an entire class of very popular hardware – firearms that are lawful under federal law and under the laws of most states and that are commonly held by law-abiding citizens for lawful purposes.”

Sure, the Nutty Ninth isn’t going to help. But, this is going to be the first case that presents the new ‘conservative’ Court with a substantive test of its 2A bona fides.

If Thomas, Alito, Gorsuch, Kavanaugh and Barrett can’t find the intestinal fortitude to tell California to go pound sand, then the future of the Second Amendment is bleak.

I’m not hopeful, at all.

No, he just made it less liberal. I can’t remember the exact makeup, but I think it’s around 16-13, Dem/Gop and there are two or three vacancies to be filled. So, it’s going to be worse in a few months.

Keep in mind that while Bush appointed three or four to the 9th, not all of those picks have turned out well for Republicans, surprise, surprise.

What does now happen from time to time is there is a better chance that any ‘3 Judge panel’ might write a conservative opinion. But, those are usually temporary and eventually replaced by an en banc panel.

If one state could force other states to accept the legality of a marriage license between two individuals of the same sex, a state can force other states to accept the legality of a license to carry firearms as well.

Deputize them all and send them forth to the rest of the country.

It is called a full scale border invasion intended to take over Texas.

Back against the wall situation. Governor Abbott when he was AG brought more lawsuits against the Fed Gov and won than anyone before him. He is capable of doing this.

Not really. The 'republicans' of Texas can always be counted on to support largely symbolic gestures that have no actual effect until far down the line.

Constitutional Carry only took 10 years to get through our legislooters.

The problem is, that all the real grifters know that in most parts of the state, a democrat can't be elected dog catcher, so because they are immoral anyway (otherwise they wouldn't be democrats), they just pretend to be Republicans, and mouth all the appropriate words, but work very strongly behind the scenes to make sure that little to nothing conservative is ever accomplished.

Time for a Constitutional amendment - would prefer national level but state level will work:

No jurisdiction that is subject to this Constitution, shall restrict, regulate or institute legislative controls over the purchase, ownership, possession, manufacture or carry of any firearm, ammunition, ammunition handling device, or accessory that is more restrictive than federal law on private property, public access property or public right of way locations.
