Governor Ivey Issues Executive Order to Fight Overreaching Covid-19 Vaccine Mandates

MONTGOMERY – Governor Kay Ivey on Monday signed Executive Order 724 to fight the overreaching covid-19 vaccine mandates from the federal government. In doing so, Governor Ivey released the following statement:

“The federal government’s outrageous overreach has simply given us no other option, but to begin taking action, which is why I am issuing this executive order to fight these egregious covid-19 vaccine mandates. Alabamians – and Americans alike – should and must have the choice to roll up their sleeves to get this shot and certainly not forced by government. While President Biden laughs at the idea of protecting your freedoms, I will continue fighting for Alabama businesses and their employees.

“If the federal government presses on with these new federal mandates, then the Biden White House has once again failed the American people. As I have stated, no doubt, this will be challenged in federal courts. I am already working in concert with Attorney General Steve Marshall, because Alabama is standing firm in this fight. This latest move by the federal government is what I believe is an illegal overreach, and I am confident we will win the battle in the courts.

“I am adamantly opposed to federal mandates related to the covid-19 vaccine and adamantly opposed to state mandates related to the covid-19 vaccine, plain and simple. As long as I am your governor, the state of Alabama will not force anyone to take a covid-19 vaccine. Through today’s order, the state of Alabama is making our position on this issue crystal clear. A state law in response to President Biden is not enough. The courts are where this will be resolved. Today is one step in this fight, but certainly not the last.

“Alabamians are overwhelmingly opposed to these outrageous, Biden mandates, and I stand firmly with them.”

So here is an interesting legal question. Given that the courts have ruled that under Federalism, Federal law trumps state laws that are in conflict, how about the following scenarios.

Presidential EO vs State Law
Presidential EO vs State EO

Can a President, without supporting law from Congress, use the EO authority to “trump” state law? I am of the opinion that no, he cant.

But lets ask the question backwards. Can a state law prohibit or even burden the federal government’s execution of the EO? I would think not. Given that the Constitution enumerates that the President is the head of the executive branch, it would seem that the President has wide authority to specific the conduct of the Federal government. But what about other business and enforcement via OSHA? But is there a limit? Can the Federal government do anything it wants inside of a state? Can it simply ignore state law?

Lastly, where is the break down of State’s rights / 10th amendment. I am of the personal opinion that unless the Constitution enumerates a power to the Federal government, that power is reserved to the State. In this case, a vaccine mandate does not appear in the Constitution and as such, should be reserved to the State.

I suspect that this is going to get sorted out by the courts and ultimately SCOTUS.

My question is, what can and will a governor do when OSHA cites a company? I really don’t see what they can do. The knee jerk reaction is, “don’t pay the fine”. That’s not going to work. The employer will inevitably end up in the federal court system for failing to pay the penalties.

This Federal vs States has already been determined. When states and cities decided that they would give sanctuary to illegal aliens the Feds should have stopped it as a breach of Federal law. They chose not to. That set a precedent for ignoring Federal law. It may come back to haunt them. What Federal laws do we obey and which can we ignore?

As long as she’s headed in the right direction now. We need to get critical mass on this.

Also, I think some of these pols really did believe the hype on covid at the start, but are actually beginning to admit reality now.

OK, I’m hoping she was just misguided. I think this is an incredible statement and appreciate her efforts. Last week she banded CRT in Alabama schools. Memaw is performing extremely well in this Alabamians opinion

It is my understanding that there is no formal Executive order or mandate. This is why state governments cannot sue because there is nothing to sue over.

That is actually the only real solution there is, but nobody, Ivey, Desantis, nobody, has the guts to do it. It would effectively be declaring war on the federal government.

I guess my point is ... what Biden is doing is not Federal law. It is less than that as it is only an executive order.

Yes they did.

They dropped the shot mandate, saying the would not be firing those who won’t or don’t get the shots.

Heard on Chris Kroc show WBAP tonight.
