NY AG James: ‘We Need to Follow’ CA Gov’s Lead to Allow Citizens to Sue Gun Sellers, Makers

New York Attorney General Letitia James (D) said Tuesday on ABC’s “The View” that she was looking into following Gov. Gavin Newsom’s (D-CA) recent proposal to allow private citizens to sue manufacturers and distributors of assault weapons.

Co-host Sarah Haines said, “Last the Supreme Court refused to block a Texas law that allows everyday citizens to sue abortion providers. Then California Governor Newsom wants to take that law and flip it and allow citizens in his state to sue assault weapon and ghost gun providers. Would you do something like this? is it an effective legal strategy?”

AD James said, “The answer is yes. When I heard about that, I said to my team we need to follow his lead. The reason why that is is because gun manufacturers and gun distributors in this country are immunized. No liability whatsoever. They’re the only industry that is protected in this country, and given the carnage and given the fact that this is the ninth anniversary of Sandy Hook, I am sick and tired of prayers and individuals whose hearts go out to all of those who have lost lives. We can do something about it. What we need to do is hold these gun manufacturers and these gun distributors liable.”

She added, “We are reviewing it and talking to California, and so this is a first. Yes, The Office of Attorney General Letitia James is looking at that model, and I congratulate Governor Newsom.”

Sue firearms manufacturers and sellers for the crimes committed with their product?

Great. Then we can sue Ford and the local dealership for drunk drivers, right?

Hey, even better, when someone uses a legal loophole to embezzle millions, we can sue the State and the Governor too, right?

After all, if manufacturers are to be responsible for the uses their products are put to... The government's product is laws and regulations, we can sue for recovery from misuse of those too. Go ahead, set the precedent.

STOP selling your guns to law enforcement and all government entities in NY. NOW!

If this is not done then....Calling all American gun buyers, STOP buying Glocks until they STOP selling guns to NY and CA.

I don’t believe this is correct. They can be sued if they manufacture a faulty firearm. Congress did pass a law prohibiting law suits against manufacturers for what criminals do with their properly-operating products.

Isn’t that basically what I wrote. Firearms manufacturers can be sued for defective products, but not for the damage/injury committed by criminals using firearms.

I don’t know. I wasn’t invited to your birthday. What were the models, and how long did it take you to get through the red tape necessary to own these fully automatic firearms. Or did you use firearms belonging to a range, which lent them to you?

That’s exactly what Ron Barrett did when California added his .50 BMG rifles to their list of “assault” weapons. He refused to sell to any government agency, refused any maintenance/repair work, and even refused to ship rifles that had previously been sent to his shop by LE customers in California.

He took a strong line with that last point “If you want your rifle, you can drive over here to Tennessee and pick it up.”

Cost him a bunch of money, but he has stood firm all these years. Not many are able/willing to do that, and it’s probably impossible for a publicly traded company to take a similar stance, but it’s good that some are willing to sacrifice financial gain for doing the right thing.
