Obergefell Claims Marriage Equality Is Threatened if Roe Is Overturned

Jim Obergefell, the lead plaintiff in the landmark Supreme Court case Obergefell v. Hodges, which legalized gay marriage in 2015, argued that marriage equality is threatened in the United States if Roe v. Wade (1973) is overturned.

He is correct - Obergefell v. Hodges is threatened, as it should be.

SCOTUS's 1973 Roe v. Wade ruling unwisely removed a decision on the legality of abortion from the political process and a vote of the people.

By the same logic, Obergefell should also be overturned, and the issue should be decided by individual States and the political process.

What Roe vs. Wade and Obergfell have in common, is that they were cases used by the liberals, to force their views on a contentious social/political issue through the courts, and impose it on the entire nation. They used these cases to end debate and deliberation and force all of us to abide by the most liberal view of an issue.

And the same reasoning used by Alito in this current case, could be used to send the issue of defining marriage back to the states. If that happens, we will see a liberal meltdown.

But just because liberals have a meltdown, doesn’t mean that dealing with an issue the opposite of what liberals want to see is not valid. The Supreme Court’s own 2013 decision on marriage, which mandated that the federal government recognize same sex marriages from states which allowed same, acknowledges the states administer marriage and family law.

I believe he is correct. Marriage from a Perspective of the Constitution, was always a state right.

Obergefell is only in jeopardy if a state enforces a law against gay marriage and it goes to federal court. I find that hard to foresee, given the times we live in.

Both are clearly Judicial Overreach in issuing legislation from the Bench.

SCOTUS needs to be sanctioned.

I would have assumed that a state completely barring abortion with no exceptions for rape, incest, or the life of the mother was unlikely too, but it turned out not to be the case.

Same sex “marriage” is something to be decided by each state-not. the. fed. The same goes for Roe v wade/abortion-it is up to the individual state to decide-states’ rights-even RBG said Roe was badly decided...

Where are you getting that “life of the mother” thing? It is not true in Texas-life of the mother means her life is saved 1st-but rape or incest are not threatening the life of the mother, so whether she can get an abortion or not is up to each state-and in Texas, she can do that up to heartbeat being detected-about 6 weeks-an early pregnancy test is accurate weeks before that, and i can’t think of any woman too stupid to use one, especially if she has been subjected to unprotected sex by rape-so no excuse to wait-it isn’t the unborn human’s fault that something horrible happened...

I find that hard to foresee, given the times we live in.

I think you will see multiple suits challenging Obergfell within months, if not weeks, of Roe being struck down.

Look at the havoc so far. It’s unbelievable.

Why am I against homosexual marriage? For one thing, it makes being a Christian a legal liability.

It should be overturned. Marriage exists to protect the family unit. Since same sex couples cannot breed, they cannot create families. I know this puts adopted children on a lower pedestal, but that’s just something they’re going to have to live with.

Marriage is a simple contract between man and woman....and each state has always had their own rules.

There's no such thing as gay marriage.

For gays...it's all about benefits.
